General Orders, No. 21.

I. In pursuance of General Orders, No. 63, issued from the Adjutant and Inspector-General's Office August 6th, 1864, companies for local defence are hereby authorized and required to be organized in each county and corporation of the State. As soon as practicable the appointment of a competent person to organize and permanently command the local forces of each county and corporation will be announced. Application for such appointment, with suitable references and recommendations, should be addressed without delay to these headquarters. The commander of a local force of four companies will have the rank of Major; of six companies, the rank of Lieutenant-Colonel; of ten companies, Colonel. If the whole local force of a county or corporation be less than four companies, it will be consolidated with the local force of some contiguous county. II. The persons appointed to organize and command the local forces will be authorized to select suitable men to raise companies within the limits of their respective counties and corporations. No company will be accepted with less than forty men, rank and file, nor until a complete muster-roll of the company shall have been forwarded to these headquarters. Blank muster-rolls can be obtained upon application at these headquarters, or to any reserve rendezvous commander in the State. None but detailed men and exempts will be enrolled in the companies. III. The companies organized under this order are designed to be employed in repelling raids and sudden luemsions of the enemy. They will not be called out except in emergencies occurring in or near the counties to which they belong, nor will they be required to perform any service except within the limits of their respective counties and of counties contiguous thereto. IV. All detailed men, unless specially excepted, including those between the ages of eighteen and forty-five years, as well as those of the reserve class, are required, and will be compelled, to enroll themselves as members of the companies; and upon their failure to enroll themselves promptly, upon being notified so to do, their details will be revoked and they will be appropriately assigned for active duty among the forces serving in the field. V. All men who are exempt from military service and capable of bearing arms will be accepted as volunteer members of the companies, and they are earnestly invited to enroll themselves for the defence of their homes. VI. The term of service of the companies will be the unexpired period of the war. The term of service of detailed men will be the terms of their respective details. VII. The local forces will be drilled, either by companies or squads, weekly; and there shall be at least one company drill in each month. VIII. Enrolling officers throughout the State are enjoined diligently to co-operate in the formation of the companies. By command of Brigadier-General Kemper. R. H. Catlett, Assistant Adjutant-General.

Richmond Dispatch. Monday morning...August 22, 1864. The War News.

An official dispatch, received at the War Department Saturday morning, states that General Hill attacked the enemy's Fifth corps on Friday afternoon, at Dovis's house, three miles from Petersburg, on the Weldon railroad, defeated them and captured about twenty-seven hundred prisoners, including one brigadier-general and several field officers. The loss on our side is believed to be smaller than that of the enemy. Brigadier-General Clingman was wounded in the leg.

Detailed accounts of this engagement will be found elsewhere. Twenty-four hundred prisoners, captured on Friday evening, arrived in this city on Saturday and yesterday. Among them are the following commissioned officers:

The following are the casualties in the Richmond Grays, Twelfth Virginia regiment, in Friday's fight: Killed — Thomas C. Walsh. Wounded — A. F. Rogers. Missing — M. M. Bowen, George B. Gibson and George James.

So far as we have been able to ascertain, there was no fighting on Saturday. At an early hour yesterday morning, however, a heavy cannonade commenced along the lines, which continued for some hours. During the morning our forces attacked the enemy on the Weldon railroad, and the fighting was severe the remainder of the day. There were many rumors last evening in regard to the result of the fight, but as the train failed to arrive, and we have nothing from the agent of the Press Association, they all lack confirmation.

We only know that the enemy were driven from their advanced position back to their main line of entrenchments, and that they still held the railroad last evening. Reliable accounts will doubtless be received from Petersburg at an early hour to-day.

Below Richmond.

Nothing of importance has occurred on the north side of James river, below Richmond, since the reconnaissance on Thursday. The two corps sent over by Grant, it is ascertained, have recrossed to the south side, leaving only the division commanded by Foster, which has been at Deep Bottom for some time past. The firing heard on Friday evening was the enemy's gunboats shelling Howlett's field, a position in which they supposed the rebels had created a battery. It was without effect, save an useless expenditure of Yankee ammunition.

Northern papers of the 17th assert that the object of the movement on the north side of the James was to destroy the rebel pontoon bridges above "Fort Darling," as they call Drewry's Bluff; while papers of the 18th are quite as positive that it was only a reconnaissance to ascertain the strength of the Confederates in that quarter. We do not believe either of these stories. It is much more likely that it was a feint to draw General Lee's troops from the front of Petersburg. But whatever it was, it proved a miserable failure, and adds one more to the catalogue of Grant's "brilliant movements" (over the left) in this campaign.*

One day last week, the Yankee pickets in the neighborhood of Dutch Gap opened fire upon our picket line, when two of our gunboats, being in the vicinity, concluded to take a hand. Consequently, they commenced throwing shells promiscuously in the direction of the Yankees. One of the missiles struck the enemy's pontoon bridge near Dutch Gap and set it on fire, burning several of the boats of which it is composed. This Confederate salute seemed to cause considerable consternation among the Yankees.

The enemy is still engaged in digging the canal across the neck of land known as Dutch Gap. To those who are acquainted with its topography, this will appear to be a work of no small magnitude, but unless some plan can be devised to put a stop to their operations, it will be accomplished.

From the Valley.

At length we have some definite information from General Early's command, in the Valley of Virginia. An official dispatch, received at the War Department, states that a portion of our forces in the Valley crossed the Shenandoah at Front Royal on the 16th, and drove the enemy's cavalry, which retreated towards Winchester, burning the hay and wheat stacks in their route. On the 17th, Sheridan began to retire from his position, was pursued, and two divisions of the Sixth corps, with a large force of cavalry, were overtaken at Winchester and driven through the town, losing over two hundred prisoners. The enemy fell back towards Harper's Ferry.

Front Royal, the point at which the Shenandoah was crossed, is situated in the extreme southeastern angle of Frederick county, twenty miles from Winchester, in a valley between the river and the Blue Ridge, near the junction of the counties of Culpeper, Fauquier and Shenandoah. Strasburg, from whence Sheridan commenced his retreat, is in the northern part of Shenandoah county, on the north branch of the Shenandoah river, immediately on the main road from Woodstock to Winchester, and eighteen miles south of the latter place.

It is stated (not officially) that Sheridan's entire force in the Valley amounts to 41,000 men. His retirement from our front to Harper's Ferry may be regarded as a prudential measure on his part.

It is reported that on Thursday, the 18th instant, General Early captured five hundred prisoners near Winchester, and was still in pursuit of the enemy.

From Florida.

The following official dispatch, announcing a successful affair in Florida, was received at the War Department yesterday:

"Charleston, August 20. --Captain Dickinson with a greatly inferior numerical force, engaged the enemy's cavalry and artillery at Gainesville, Florida, on the 18th, and completely routed them, capturing one hundred and fifty prisoners, one piece of artillery and one hundred stolen negroes. The enemy was pursued fourteen miles and scattered. * *

Additional from the North.

We have received, through the courtesy of Captain Hatch, files of Northern papers to the evening of the 17th. We give from them some details of news:

The movement up the James river.

Additional particulars have been received of the action of Sunday. Part of the Second corps and part of the Tenth corps engaged the enemy in the afternoon near Deep Bottom.

The Tenth corps, under General Birney, captured part of a line of earthworks with four eight- inch brass guns and a number of prisoners. His loss was small. The enemy fell back to a strong position.

The second division of the Second corps was drawn up in line of battle and advanced about a mile beyond where General Hancock captured the four guns two weeks ago. Here the First brigade, Colonel Mace commanding, took the lead and charged across a corn-field over a hill and down into a ravine, where they came to a swamp, with a stream on the other side, and the ground covered with impenetrable brush on the margin. During all this time they were exposed to a heavy fire from the rebel artillery, which did a good deal of damage.

As it has proved impossible to cross the ravine, the men were halted, and lay concealed as well as possible until dark, when they were withdrawn. Colonel Mase had his horse shot under him, and mounting General Barlow's horse, the animal became unmanageable, and finally falling on the Colonel, badly bruised him.

The Colonel was wounded in the Wilderness battle, and had returned to the field only a day or so before. The division lost three hundred men in this engagement.

The First and Third divisions, which were in support, lost about two hundred and fifty in killed and wounded from the effects of the rebel artillery. The wounded were all brought off, and are nearly all being cared for at City Point.

Lieutenant-Colonel Warren, of the Thirty-sixth Missouri, lost his left arm while gallantly leading his regiment in the charge. Major N. H. Hamilton, of the Thirty-sixth Missouri, was severely wounded in the face, and Captain Lindley, of the same regiment, killed, Sergeant Bailey, of the Thirty-sixth Wisconsin, was killed, and about twelve of the men wounded. Sergeant Fuchs, of the Thirtieth Wisconsin, color-bearer, was badly wounded, (the third time for him in the present campaign).

Our troops still hold their position in front of the enemy's works, which are very strong — naturally so — owing to the formation of the country in the vicinity.

General Butler's canal.

A letter from the Army of the Potomac says:

For some time past Major-General Butler has been counting over a brilliant scheme wherewith to annoy the enemy and advance the Union interest in this region materially. His plan contemplated nothing less than the construction of a canal at what has hitherto been known as Dutch Gap — hereafter to be known as Butler's Gap — in the direct face of the enemy, which, when done, should, among other results, by reason of its situation, compel the rebels to extend their line of defence a distance of four miles--that is to say, the distance saved to us by the digging of the canal, which is to be one hundred and forty yards in length, is seven miles of water course in the James river.

Some four days since the proper details of men and officers were made for this important and hazardous work, and these men were encouraged to its performance by extra inducements, and placed under the general command of Major Ludlow, of the departmental staff. The work proceeded handsomely for three days, during the last of which the enemy discovered our operations and made instant preparation to open fire, which the result will show to have been an advantageous one for them, though Ludlow nobly and successfully held his position, still holds it, and will continue to hold it until his appointed work is accomplished.

At five o'clock yesterday morning two rebel rams, believed to be the Virginia and the Richmond, though some think one of them was the Lady Davis, appeared at Dutch Gap, in the James river. The James at this point forms a promontory, which is very narrow at its apex. The shape of this promontory is in the form of a long tongue, and, verging to the northward and westward, makes another turn, which forms another point similar to the first, east by north. Hense the river bends yet again, and forms a third angle, running northwest. Under cover of this angle, completely and literally sheltered from our gunboats, lay the two rebel rams. Their position was such as, taken in connection with the Howlett House battery of the enemy, to subject our forces to a severe enfilading fire, which was borne throughout the day with manly fortitude by our men.

The successful construction of the canal, of which there can be no doubt, will, it is alleged, enable our gunboats to wholly overcome the formidable obstructions in the James river, and possibly ultimately be the means of their engaging Fort Darling and other rebel strongly- fortified places adjacent to Richmond, and perhaps, before the end comes, operate largely in the reduction of the rebel capital itself. These are glowing anticipations; but, nevertheless, they are capable of realization by patient and indulgent waiting for. Any one of these results, added to the necessity imposed upon the enemy of lengthening his line of defence a distance of four miles, requiring several thousands of men to man this prolongation of their lines, will certainly be regarded as adequate compensation for the time, labor and men bestowed upon the accomplishment of the undertaking.

The negroes, who are largely engaged upon the work of constructing the canal, behaved well under the continuous and galling fire of the day, never for an instant flinching, but standing to their work manfully and creditably. This fact was a source of favorable comment during the day, and I am glad to be able to record it.

Continued Depredations of the Tallahassee — a heavy List.

The schooner Sophia, from Turks island, has arrived at Yarmonth, Nova Scotia, with the crews of the following vessels, sunk by the "pirate" Tallahassee:

Ship Littlefield, of Bangor, Maine, from Cardiff for New York, sunk on the 14th, in latitude 42 degrees, longitude 66 degrees; schooner Lamont Dupont, of Delaware, sunk 13th, in latitude 40 degrees, longitude 18 degrees; schooner Mercy A. Howe, of Chatham, sunk yesterday, in latitude 43 degrees, longitude 66 degrees.

After the crews of the above vessels were put on board the Sophia, the Tallahassee sunk four other schooners, one of which was the J. H. Aowen, of Gloucester. The smoke of the steamer was seen this morning in the direction of Seal island.

Thomaston, Maine, August 17.--The rebel steamer Tallahassee on Thursday destroyed twenty-five vessels off Mattinicus Rock. She was manned mostly by Nova Scotia men.

After sending the crews and passengers of the vessels destroyed into Friendship by a small craft, she steered in an easterly direction.

Boston, August 17.--A dispatch from the American Consular Agent at Yarmouth, Nova Scotia, to this city, states that six more vessels were destroyed by the pirate Tallahassee on Monday, six miles from Cape Sable. Thirty men of the crews were landed at Yarmouth in a destitute condition. The pirate was in sight on Monday morning.

A raid into Illinois--five steamers captured and Bonded. Cairo, August 15.

--About five hundred rebel cavalry, under Colonel Johnson, crossed the Ohio river into Illinois, at Sabine Bar, on Saturday. The steamers Kate Robinson, Jenny Perkins, Nightingale, Famine, Brandon and Clara Hall were all aground at that place, and were captured, with a large amount of stock on board. The boats were compelled to pay several thousand dollars each to save them from destruction.

The operations in Sherman's rear.

A telegram from Louisville, dated the 16th, gives the following about General Wheeler's operations in the rear of Sherman's army:

Wheeler, with seventeen hundred men, demanded the surrender of Dalton, Georgia, on the evening of the 14th, of Colonel S. C. Bold, of the Second Missouri, commanding that post with eight hundred men. A slight skirmish was going on when the train left. General Stedman was telegraphically advised thereof, and started with a large force from Chattanooga.

The latest heard from Dalton was just at nightfall on the 14th, when cannonading was prevailing. Rumor says that trains were leaving Resaca. This raid has been anticipated by General Sherman, and he was prepared to meet it at all important points.

On Saturday, three hundred guerrillas attacked Selma, Livingston county, Kentucky, garrisoned by three hundred of the Eighth Kentucky, and after a sharp fight they were repulsed with the loss of eight killed, fifteen badly wounded, and several captured.

Miscellaneous.

Assistant Surgeon S. J. Grimes, Thirty-second Ohio, has been dismissed the service for straggling, being captured, and giving important information to the enemy. Assistant Surgeon R. W. Willoughby, United States colored troops, has been dismissed the service for physical disability, caused by the use of whiskey and opium.

Ex-Mayor Park, of Memphis, was arrested and lodged in the Receiving Prison in that city on the 11th instant for using indiscreet language in regard to the military authorities.

At the Democratic District Convention in Bangor Mc., James C. Madigan, of Houlton, was nominated for Congress from that district. Resolutions announcing the war as unconstitutional, and favoring an armistice and immediate negotiations for peace, were adopted.

We learn, by the way of New Orleans, that all of the Texas coast, Brownsville included, has been evacuated by the Union troops, with the exception of Brazos island.

William H. Rodgers, John R. H. Embert, Braston Lyon and Samuel B. Hearn have been sentenced to be hung in Baltimore as Confederate spies.

Foreign News.

The Asia, with European dates of the 6th, has arrived at New York.

The Australasian's news had no effect in London. The friends of the North were much disappointed that the reported capture of Atlanta was not confirmed,

while the Southern sympathizers loudly rejoiced. The Morning Post has in editorial denouncing the kidnapping of British subjects for the Federal service, and refers specifically to the case of seven Irishmen who were subjected, in June last, to gross indignities after their release was obtained, and says, if the facts are proved, the British Government should not be satisfied with anything less than the exemplary punishment of all concerned in the out-rages.

The Times has an editorial on the same subject, holding it up to Irishmen as a warning not only against the Federal service, but against emigration to America.

The London Daily News editorially refutes the representations against the labor market in America, and shows that it is in a most healthy state, and offers irresistible attractions to emigrants.

The Settlement of the Danish War.

The arrangement of the Danish question has been confirmed via Copenhagen. Denmark completely cedes the Duchies to Austria and Prussia, together with Jutland and Euclares, the town of Ribe excepted. The occupation of Jutiand continues till the final conclusion of peace. The President of the Danish council communicated the matter to the Rigarad at a private sitting, and on the following day a motion was offered, and supported by a considerable number of members, declaring that the silence with which the announcement was received must not be construed into an approval of the conduct of the government.

Furloughs have been granted to all the Danish recruits undergoing a preliminary drill, and troops are returning to Copenhagen from Funcer. The German papers assert that the Duchies are surrendered in their entirety, without reservation, and Austria and Prussia have full liberty to dispose of them. The Austrian Government has addressed a circular note to its representatives abroad, giving an analysis of the preliminary peace arrangements, and stating all the questions reserved for future disposal.

France.

The weekly return of the Bank of France shows an increase of half a million of francs in species. The King of Belgium has arrived at Paris from Vichy. The Bourse was declining. Rentes are quoted at 66f. 30

Poland.

M. Trangog, the head of the Polish National Government, together with four chiefs of the department, were hung on the 5th instant on the glacis of the citadel. The sentences of death of eleven other officials of the National Government had been commuted.

General Hood Increases his army.

--The Atlanta correspondent of the Columbus Enquirer says that General Hood is rapidly increasing the fighting men of his army:

General Hood is putting guns into the hands of every available man connected with the army. --All of the cooks have been armed and returned to their respective commands, and the negroes connected with the army have been employed in that capacity. Quartermasters and commissaries have been made to disgorge the many superfluous men in their departments; surgeons also. The result is that the army has received a considerable reinforcement. In Clayton's division alone the number of new men returned from the cooking detachments reached three hundred, which at this time is considered a good regiment. The increase from the cooks alone will reach four thousand effective men.

But General Hood does not stop here. He has ordered the arming of every artillerist except from No. 1 to 6, who are absolutely necessary to handle a piece; from this source an increase will be obtained amounting to near three thousand men. I must say, however, that this order converting artillery into infantry caused considerable fluttering among the battery boys. True, many of them take the thing quite easy, being perfectly willing to serve the country at this critical juncture in any capacity that will aid in the overthrow of Sherman and his "Hessians." From this our readers will at once perceive that General Hood is determined to leave nothing undone that will subserve the great interest of the country.

I am proud to say thousands of Georgians are responding to the last call of Governor Brown. If a general engagement can be delayed one week longer, and the enemy retain their present position, Sherman and his army will be routed.

Sherman does not manifest a disposition to shell Atlanta. For two days he has not thrown a shell into the place.

Large quantities of tobacco continue to be unearthed and brought forth from its hiding places in and around Atlanta, which General Hood promptly impresses for the use of the army. There is no doubt but what the owners thought that Atlanta would be evacuated and then they and their tobacco would fall into the embrace of the Yankees.

Why Chambersburg was burnt.

--This act is thus explained in a letter from Maryland to the New York Herald:

"Just before leaving Williamsport, General Early made some public remarks in regard to the burning of Chambersburg which are of interest. He said that he ordered one hundred thousand dollars in gold to be demanded of the town; and that if the demand was not complied with in three hours the town was to be burned; that the sum of money demanded was to reimburse Andrew Hunter, William Lucas, E. J. Lee and Hon. Alexander R. Boteler for their losses, caused in the destruction of their property by order of General Hunter, and that he felt perfectly justified in the course he had pursued. He explained how General Hunter had burned the house of his (Hunter's) cousin, in Jefferson county, Virginia, and taken that cousin (Andrew Hunter) off as a prisoner, and said that the act was a brutal one, because the inmates of the house were not allowed time to save even a portion of their clothing. In concluding, he said it would be the future policy of the rebel Government to retaliate in the severest manner for all barbarities practiced against them.--He delivered these remarks in a calm, firm manner. In a private conversation, he said that no man more than himself deprecated the necessity of such an act as the one committed at Chambersburg, but that he sanctioned it, believing he was only doing his duty to those people who had suffered by General Hunter's orders; and again, because he believed that by retaliation such barbarous practices would be sooner discontinued than in any other way. He was particularly severe on General Hunter, and said that, should he fall a prisoner into their hands, his lot would be a hard one."

Operations in Sherman's rear.

--It is stated that Wheeler has destroyed the bridges across the Etowah and Oostanaula rivers and burnt the track the whole way from Marietta. A large amount of stores are said to have fallen into his hands at Resaca, which was destroyed after our cavalry had appropriated all that was needful to them. At last accounts, the report says General Wheeler was rapidly marching in the direction of Dalton, where an immense amount of stones, both subsistence and ordnance, has been congregating for some time.

From the Macon Confederate of Friday we learn that General Wheeler massed his cavalry corps near Covington, on the Augusta railroad; and on Monday morning the grand cavalcade of gay cavaliers started for adventure and Sherman's rear. It was rumored in town yesterday that he had captured Marietta and burned the Federal stores there, and had taken an immense number of prisoners. Be it as it may, it is certain that the long-expected effort to cut Sherman's communication is now about to be realized. The Federal cavalry have nearly all recently been destroyed; and General Wheeler is now out just at the right time.

We are assured by gentlemen direct from headquarters that there is not the slightest intention entertained there of a retrograde move or the evacuation of Atlanta. On the other hand, it is expected that Sherman will be forced to retreat.--Charleston Mercury.

Contentment.

--In Vienna, a magnificent house was built by a nobleman, on the front of which is a stone with the inscription: "This house was erected by Count D--, to be given to the first man who can prove that he is really contented." One day a stranger knocked at the gate, and desired to speak with the master. "I have come," said he, "to take possession of this house, as I found you have built it in order to bestow it upon the man who is really contented. Now, I am in that state, of which I am willing to make an oath; you will, therefore, give me immediate possession." The Count did not interrupt him till he had finished his speech, when he replied, "You are quite right, sir, with respect to my intentions, but as I do not discover the least pretension you have to the character of a contented man, I hope you will retire. If you were quite contented you would not want my house."

The fight at Petersburg.

The Petersburg Express contains an account of the fight near that city on Friday. It appears that on Thursday our forces, after attacking the Yankees on the Weldon road and driving them one mile, ceased the pursuit, and fell back to a point nearer the city, leaving only a skirmish line in front of the enemy, which was also soon after withdrawn. The Express says:

The enemy did not discover our disappearance from their front until yesterday morning, when they immediately threw forward their lines of skirmishers and advanced their left to the battle-field of Thursday, in Davis's corn-field, throwing up, as they advanced, two lines of breastworks. Their right was extended in an oblique direction to the northeast of the railroad, and batteries were placed at favorable points along the whole line.

This occupation of one of our main lines of communication with the South was, of course, not to be permitted without an effort to dislodge the enemy. Accordingly, all arrangements having been completed, General A. P. Hill, commanding Mahone's and Heth's divisions, attacked them between the hours of 3 and 4 o'clock. General Mahone commanded the troops to the left of the railroad, and General Heth those to the right. The attack was opened by Mahone, and was speedily responded to by Heth on the right, and the battle raged furiously.

On the right, General Heth, with the gallant brigades of his divisions — Davis's, Walker's and Archer's — struck the enemy's picket line in the cornfield a short distance beyond Davis's residence.--These were quickly forced back upon the first line of breastworks, held by a formidable force. With a cheer, the Confederate troops bounded forward and swept over all obstruction, pressing the Yankees back with severe loss into their second line; and charging onward, forced them thence with an equal lack of ceremony. Beaten from their works, and defeated in their every effort to retain them, the Yankees retreated to their main line of entrenchments, into which they had been driven on the previous evening. This line having been greatly strengthened, proved too strong to be stormed, and our troops were checked in the face of the slaughter which threatened a further advance.

In the meantime, General Mahone, with Clingman's, Colquitt's, and his own former brigade, had struck the right of the Yankee lines and captured eight hundred prisoners. Pressing forward with his usual energy, he drove the enemy before him, successfully charging them wherever they made a stand. Finding them strongly entrenched, however, in the thick woods opposite Davis's farm, it was determined to dislodge them by a flank movement. Clingman's and Mahone's old brigade engaged them in front, while, by a circuitous route, Colquitt's (Georgia) brigade was thrown on their flank. The movement proved a brilliant success, and caused scarcely any loss to our troops.

Colquitt's men were upon the Yankees almost before they were aware of such close proximity of the rebels, and surrender or fighting under fearful disadvantage was the alternative. Crawford's crack division, of Warren's (Fifth) corps, here fell a helpless victim to rebel strategy, and the greater part of two brigades — numbering over two thousand men--threw down their arms and surrendered. The prisoners were quickly placed under guard and sent to the rear, where they were formed into line and marched to General Hill's headquarters.

The battle still progressed successfully until the enemy was driven back to the position from which he advanced in the morning. At dark, our lines were close up to his works, and occasional volleys of musketry showed still farther fighting.

Among the prisoners taken is Brigadier-General Hays, of Massachusetts, several colonels, and other field officers of less grade. General Hayes was brought into town last night.

During the engagement we left a number of men taken prisoners, but we understand they were afterwards recaptured. The success which followed the attack threw our men into the best spirits, and every soldier wore a smile of satisfaction upon his countenance.

The result of the attack is highly satisfactory to the officers in command, and is viewed in the most favorable light. The enemy has been materially weakened by the loss of three thousand of his best troops taken prisoners and several thousand killed and wounded. He is demoralized by his defeat, and though he may fight hard yet to hold the position he has gained, his prestige is gone, and he will not offer the front he has shown during the last few days.

The weather was rainy during the day, and especially so during the afternoon. The fighting was done amidst a series of heavy showers, which not only incommoded our men, but rendered the ground heavy and slippery. Most of the fighting on our left was done in a dense growth of underbrush and woods.

We can form no estimate of the Yankee loss other than the statement of officers that it was very heavy, Many of their dead and wounded fell into our hands. Nor are we able to form an idea of our own loss, as up to night but few of the wounded had been brought from the field. The great majority of those we saw were slightly wounded. We shall learn further particulars of the casualties and of the battle to-day. We regret to state, however, that General Clingman was painfully, though not seriously, wounded.

The battle for the possession of the railroad will probably be resumed this morning, and it is believed the enemy will not only be dislodged, but disastrously defeated. This expedition will turn out, in the end, to be the greatest disaster that has yet happened to Grant in this department.

Reports from the battle-field, late last evening, represent our forces between the enemy and the main army in front of Petersburg. If so, something interesting may occur to-day.

It is also stated that several hundred more prisoners have been taken, thus running the number above three thousand.

As the enemy still hold the railroad, it is impossible to state what damage has been done the track. It is believed, that instead of sending a body of raiders across towards the south side, the enemy's cavalry are operating on the Weldon road in the rear of the army.

Local matters. Important Habeas corpus case.

--A. J. Camp, of Amherst, Virginia, came before Judge Meredith's Court on Friday, the 19th instant, on a writ of habeas corpus, directed to General Eppa Hunton. The petitioner was represented by Mr. John M. Speed, of Lynchburg, and Messrs. Nance & Williams, of this city; the counsel for the Government, Colonel Thomas P. August, of the Conscript Bureau, and Mr. James Neeson.

The petitioner based his claim for exemption on the fact of having been recently, and while in service, elected as a Justice of the Peace, and under the conscript law and the resolutions of the Legislature, entitled to a discharge. The only testimony offered was the certificate of his election by the County Court and the recommendation of the Governor for his exemption. The counsel for the Government made str exertions to deafest this claim, as it would set a precedent for other cases of a similar character. They claimed that after a man has once got into the service, there was no human power, except that which put him there, that could take him out, contending that exemption and discharge were not that Congress had made provision for exempting certain parties, but none for discharging them. After elaborate arguments by counsel on both sides, the Judge decided that the party was entitled to his release, and, accordingly, discharged him. The for the Government entered a bill of exception, intending to take the case up to the Court of Appeals, and left this one decide all others of a similar character which may arise.

The Duelling case.

--Messrs. Henry R. Ballard, of the Examiner, and Edward C. Elmore, Confederate States Treasurer, made their appearance before Justice Riddick and Lee, of Henrico county, on Saturday; the first to answer the charge of being engaged as a second to Mr. John M. Daniel in a duel which was fought in the county on Tuesday morning last, and the latter as being one George W. Butler and Dr. A. E. Peticolas were examined, but as their testimony was the same which was elicited before the Mayor on Wednesday last, and which has already been published, there is no necessity of again repeating it. Dr. Peticolas, indeed, was more reticent in his testimony than on the first examination, notwithstanding the fact that the prosecuting attorney for Henrico county, Mr. John B. Young, read from legal authority to show that fear of implicating himself by answering certain questions as a witness need not prevent him from disclosing all that he knew about the duel, as nothing which he might say as a witness could be brought to bear against him in any future criminal prosecution. On this subject some discussion ensued between the prosecutor and Hon. Humphrey Marshall, counsel for Mr. Elmore; but the question was not pressed by Mr. Young, and Dr. Peticolas was therefore permitted to remain silent. In the absence of Hon. Paulus Powell, alleged to be an important witness in the case, the justices decided to continue the examination till next Saturday, at the same place, the county courthouse; and the parties entered into recognizance in the sum of $2,000 each for their appearance.

--Joseph Johnson was charged with shooting and killing Benjamin Delarme. The shooting occurred on Friday afternoon at the house of Catherine Blackinship, on

; and the facts elicited before the coroner's inquest, which were published on Saturday, resulted in a verdict of acquittal of the accused of all blame in the matter, it being, as they considered, purely accidental. The Mayor reheard all the evidence which was given before the jury; but with the exception of one or two points elicited from Mrs. Blankinship and officer Granger, all the rest of the testimony was the same that was heard by them. When Granger stopped the man who was walking down the street in company with Johnson after the occurrence to inquire who it was that was with him, Johnson did not stop, but entered a house near by as if to elude arrest, into which he was pursued by the officer and taken into custody. Upon being arrested he manifested surprise, and inquired why he had been taken up. He subsequently acknowledged the shooting; said it was an accident, and remarked that when the officer met him he was in search of a physician.--Mrs. Blankinship testified that when she left her house to attend to some business which she had to transact a few squares off on the evening of the shooting, neither Delarme nor Johnson were there. , Johnson, who was coming from her house. He stopped and shook hands with her, and in answer to an inquiry from her as to where he was going, his reply was that he was "off on a tramp." She then kept on home, and learnt for the first time of the shooting which had taken place.--This testimony throwing some doubt upon the motives which prompted the deed, the Mayor concluded to send Johnson on for examination before the Hustings Court. The female witnesses — Mary Vanderlip, Eliza Laggan and Jennie Jones — being persons of evil characters, were committed to jail in default of security to appear before the court, and also to be of better behavior for the future.

William Worth was charged with stealing a horse valued at $1,500, belonging to Vincent Camalier. Mr. Camalier testified that about three weeks since he left his horse in a stable at Hanover Junction, and when he went for it, some days after, it was gone. About ten days ago he came to this city to advertise that his horse had been stolen, but before he reached the printing office he saw Mr. John M. Shepherd, Jr., riding down the street upon the horse he had lost. He inquired of Shepherd from whom he had obtained the animal, and was informed that he had purchased him from the prisoner. Shepherd at the same time produced a bill of sale signed by Worth. For the defence, a witness was introduced who testified that he saw Worth, the accused, buy the horse from a member of Rosser's cavalry, and that he saw him count out $1,500 for the animal, which he afterwards paid over to the cavalryman. The Mayor sent the case on to the Hustings Court and offered to bail the accused for his appearance in the sum of $1,000; but at the close of the morning's business he had not succeeded in obtaining the required security, and was therefore sent down to jail.

James, slave of Charles Talbott, and Samuel, slave of William H. Lewis, charged with breaking into the storehouse of William H. Cox and stealing there from two coats and three blankets, were remanded for examination. [A substance of the evidence in this case was published on Saturday.]

Zeb. Wallace, a free negro, charged with threatening personal violence towards P. Behan, was ordered to receive fifteen lashes. Mrs. Mary Cobert, charged with the same offence, was required to give security for her future good behavior and to keep the peace for twelve months.

Alice, slave of William P. Smith, was charged with stealing a coat, valued at twenty-five dollars, from John Kemple, a white man; but the evidence failing to substantiate the accusation, she was discharged.

Several parties were fined for falling to have their hacks and wagons inspected, as the ordinance requires, and a number of negroes were variously dealt with for the commission of offences of different characters; after which, his Honor adjourned the court till Monday (this) morning at 9 o'clock.

The hack drivers.

--The extortionate demands of the hack drivers of this city is not only unendurable, but in direct violation of law. Several instances have been reported where parties have been charged twenty and twenty-five dollars for riding the distance of a few squares, and it is proverbial that none of them will charge less than ten dollars to take a single person from any of the railroad depots to their residences, no matter how short the distance is. For the information of strangers in the city, and others uninformed about the matter, we append the following extract from the latest ordinance passed by the Council relative to the charges for hack-riding:

"For carrying a person not more than ten squares, two dollars; for each additional square, ten cents.--The charge for carrying not more than four persons shall never, for the whole, exceed more than four dollars, unless more than an hour be employed, and shall then be only five dollars for the first hour, and at the rate of three dollars per hour for each succeeding hour, and no charge is permitted for hitching up. In case of funeral processions, no charge shall exceed seven dollars. No charge shall be made for infants under three years of age, in charge of another person. For carrying a person between ten o'clock at night and daybreak there may be charged double the above rates, and no more. For baggage the charge shall not be more than twenty-five cents for each trunk carried outside, and nothing for any article carried inside, or for any carpet-bag or basket.

"A copy of a plan of the city, with a copy of the rates for hacks and other wheeled carriages, shall be kept by the driver of every such hack or carriage, and he shall exhibit the same whenever called for by any person employing or using said hack or carriage. And if he shall fail to exhibit the same when so required, or if for carrying a person or baggage there be charged more than is allowed by this ordinance, the owner or keeper of the vehicle, for every day of such failure, or for every time of such charge, shall be fined not less than ten nor more than fifty dollars."

An additional clause of this ordinance makes it obligatory upon every hackman to transport passengers at above rates, and upon a refusal to accept the amount, fine or corporeal punishment may be imposed, according to the status of the offender.

Fire.

--About half-past 1 o'clock on Saturday morning last the cow-house connected with the premises of Robert H. Maury, on

, was act on fire and burnt to the ground. A favorite milch cow, which was inside, suffered the loss of about half of her tail. The loss on the building was trifling, as it was of a very trail character. Before the engines arrived on the ground the structure and been entirely consumed.

Robbery.

--On Sunday morning, in the absence of Mr. Patrich Behan, who was at church, his room was entered, the wardrobe broken, open, and nine hundred dollars, which was deposited in a drawer therein, was stolen. Although Mr. Behan had a good assortment of clothing on hand, nothing was taken but the money.

Arrested as a set.

--A man named Francis T Blake, belonging to the Maryland Line, was to this city yesterday and committed to Castle on the charge of being a spy and holding correspondence with the enemy. Blake had on his person when arrested several papers of a suspicious character, and among the rest a letter directed to a Yankee brigadier-general, the contents of which were decidedly of an unfavorable character to the cause of the South.

Heavy Influx of Yankees.

--For the past two days the trains from Petersburg have been mostly occupied in bringing to this city the Yankee prisoners which were captured near Petersburg on the evening of the 19th instant. The whole number received at the Libby up to last night footed up over twenty- five hundred, including upwards of seventy-five officers, whose names will be found in another part of this paper.

Stealing a breakfast.

--The only arrest which was made by the city police on yesterday was that of a man named Michael Conley, charged with breaking down the fence of Henry Kane, in the neighborhood of the old distillery, and stealing a breakfast which had been already cooked for the family. Mike was committed to the lower station-house for safe keeping till this morning.

From Petersburg. Petersburg, August 20--11 o'clock A. M.

--Lieutenant-General A. P. Hill commanded our forces in the fight yesterday evening. Warren was strengthened by the Ninth corps. The enemy were driven about three-quarters of a mile in front and back about two miles on the flank. Twenty-two hundred prisoners, including nine commissioned officers, were captured. Night ended the fight, which was a very considerable affair.

The fight has not been resumed thus far to-day. The enemy still hold possession of the Weldon railroad.

Our losses are not heavy. General Clingman was wounded. Major Lawson, of the Fity-ninth Virginia, was killed.

The enemy's loss in killed and wounded was unascertained. The Yankee General Crawford is reported by the prisoners as killed.

There was the usual artillery duel between midnight and day between the lines in front of this city. No casualties are reported.

Floyd, now serving on board the Florida, and who was a member of the class of midshipmen which graduated in September, 1862, having just been received and compared with the standing of the graduating class, he is assigned to rank. Richmond Dispatch. Monday morning...August 22, 1864.

We regard the cry which some of the press of the Confederacy is raising for peace as fraught with raischief. Nothing could have a more direct tendency to encourage our enemy to persevere in the iniquitous war he is waging against us without, as far as we can perceive, the slightest disposition to relax or to compromise, even if compromise were possible. But it is not possible, so far as we can see, and so far as boundaries are concerned. The Government of the Confederate States has no right to give up one foot of territory belonging to, or claimed by, any one of the sovereignties whose agent it is.--The Yankee Government will not agree, at this time, to make peace without a huge slice from these territories; perhaps, in some instances, without the surrender of whole States. In Virginia, it would insist upon claiming what they call New Virginia, in addition to Old Point and Norfolk. In Kentucky, Tennessee, Missouri and Maryland, they would claim the whole State. Elsewhere their claims would be based strictly upon the principle of Now, the Government of the Confederate States cannot make any such treaty as this. It cannot cede any territory belonging to any of these States, each one of which is a nation — a sovereignty as distinct as Great Britain or France. It can make peace on no other terms, so far as we can see, than those upon which it has more than once pledged itself — absolute independence and the complete integrity of all the States. When, therefore, we hear people talking about the astuteness of the Yankees, and the danger there is of their overreaching us, &c., we do not understand what they mean.

Our people are tired of the war, no doubt, and this is the reason why they are so easily deceived by every thing relating to peace that comes from the North. They ought to understand, if they do not, that there are two parties there, one of which is in and the other out; and that the party which is out is trying to get in. The party which is in is the party which is prosecuting this war. The party which is out, constitutes two parties of the most opposite sentiments. One of them is more hostile to us than Lincoln's party. The other affects to be for peace, and uses the peace cry as a weapon against Lincoln. If they combine at all, which is extremely doubtful, it will be for the purpose of expelling the present incumbent, (a very difficult job,) and getting possession-of the spoils, which are, beyond computation, enormous, and for no purpose of patriotism. Should they even succeed, which we hold to be nigh akin to a miracle, it is very doubtful whether we should have peace. The present war causes a disbursement of a thousand million a year. We doubt very much whether there is any party in Yankeedom possessing virtue enough to resist the temptation of handling such a sum; and the successful party must forego all hope of doing so if it put an end to the war.

The New York Herald, the other day, advised Lincoln to send commissioners to treat of peace without raising the blockade or withdrawing the troops. Of course it knew, and acknowledged that it knew, that such a proposition would not be listened to. But it, of its own accord, explained what it proposed to effect. It was nothing more nor less than a trick "to take the wind out of the sails of the Peace party." Every proposition from this quarter partakes more or less of the same character. Even if we expected anything from the Peace party, which we do not, we should think it not at all advisable to mix up our cause with their proceedings. If they can really, in any manner whatever, be of service to the establishment of peace, it must be solely on condition that they keep aloof from all correspondence, or association, or suspicion of correspondence or association, with any party in the Confederate States. The bare suspicion of collusion would destroy their usefulness at once. In that view of the case, we cannot see that the interference of Mr. George Sanders and his colleagues is calculated to produce anything short of unalloyed evil.

It is humiliating — we had almost said degrading — in us to be crying out for peace. We are the party wronged; we are the party assailed; we are the party acting still, and always having acted, on the defensive. The highest authority known to the laws of our country has repeatedly declared that we are ready to make peace as soon as the enemy shall have ceased to make war upon us. What more can we do or say without placing ourselves in the attitude of suppliants to a power which has more than once spurned our offers, even upon subjects not in the least connected with peace? Lincoln is the man, and the only man, who is authorized by the Constitution of the United States to appoint commissioners to treat of peace. Any proposition from this side, to be of any avail, must be made to him. And who is prepared to place our country at his footstool, or who does not see that, by doing so, we leave it in his power to prescribe the terms? As he himself is the aggressor, by this course we acknowledge him as conqueror. Are we prepared to make this acknowledgment? Certainly we are not. No party in the Confederacy is ready for that. Then the only thing we can do is to keep on beating his armies until events, whether occurring here or within his own territories, force him to make proposals.--Then we can meet him with the only answer it is possible for us to give: Withdraw your fleets and armies, treat on the basis of independence and integrity of boundaries, and we are ready to send commissioners to settle all matters of minor consideration.

Courtesies to the enemy.

Nothing has appeared from the military pen of Beauregard more grateful to the sense of self- respect in the hearts of the Confederate people than Special Order No. 15, ordering that no communication whatever should be held between our pickets and those of the enemy. Some Confederate officers, as well as soldiers, may read with advantage that order, which speaks of "the moral disgrace incurred by troops in anything like voluntary or unnecessary association with the savage foes, who are not only warring against us, but persecuting our women and children and destroying private property. The hands of such a foe are unworthy the friendly or courteous touch of a Confederate soldier."

The soul that prompted those words is in the cause. Earnestness of nature is as essential in a soldier as an orator. We would rather listen to one electrical outburst of a "forest- born Demosthenes" then a dozen classical orations as perfect and as cold as the statues of the great masters. When the two are united, we have the highest style of eloquence; and when genius and patriotism are united in a military man, we have the model which all soldiers may do well to study. Such a warrior is Beauregard. He is not fighting for glory or the display of science. The powerful machinery of his intellect is moved by the inward of a fervid and intense devotion to his country. No one more clearly comprehends the nature of this contest, or the character of the enemy with whom we have to deal. A man of true humanity and gentlenesss, he has none of that false chivalry which fights wolves and panthers in kid gloves and recognises midnight burglars and highway robbers as honorable foemen. "Order No. 15" is the true fire of the Southern flint.

Bigness.

Immensity and vastness are the especial objects of Yankee idolatry. They are satisfied with anything if only it is big. They can even admire a virtuous action if it is done on a stupendous scale, and not after the fashion of the widow's two mites. They like any thing that is big, from a big piece of pie to a big contract. The most superficial observer of Yankee character might have predicted that this would be a big war. The monstrous in crime was always the Yankee's favorite newspaper reading. A big milder in his morning's journal was essential to his peace of mind for that day. Hence the gigantic scale of murder that the war has assumed. Everything about it is so big, except its victories; nothing little about it except its success. Even a big explosion, like that at City Point, fills him with transport. He would have liked it better if it had been a Confederate magazine, but, any way, it was big, and that fills him with delegated wonder.

One secret of his devotion to the glorious Union is that it was so big. It had the biggest territory, the biggest mountains, the biggest rivers, the biggest forests, the biggest prairies, of any country in the Universe. It would have in a century more, according to his calculation, the biggest population on the face of the earth. Two hundred millions of American freemen! The American eagle was the

biggest of all the animal creation. With one wing on the Atlantic and the other on the Pacific, he could take up the whole continent in his talons and soar away with it to the seventh heaven of liberty. Was Yankee going to give up a big country like that? I guess not.

Then, above all, the big cotton crops, with a big nigger in the bale, the big commissions and the big commerce proceeding therefrom. Wonderful that all this love of bigness has never produced anything big but big fortunes and big luxury. It has never brought forth a big spies like Homer, or a big Coliseum like that where eighty thousand Romans witnessed the combats of the gladiators; or a big church like St. Peters; a big philosopher like Bacon; a big poet like Shakespeare; a big orator like Chatham; a big soldier like the "little Corsican." --But that is not the kind of bigness adapted to Yankee capacities. A mammoth ox or an overgrown prize-fighter, like the Goliath who went across the ocean to take the starch out of John Bull's collar, and came back in a very rumpled and placid condition, is the bean ideal of Yankee bigness.

It may seem strange that a people themselves so little should have such a passion for all that is big. But that is in accordance with the law of contraries in the human mind. People generally admire their opposites. None are as great idolaters of courage as cowards, or of physical strength as the weak.--Men are often more ambitious of reputation for qualities which they do not possess than for those in which their superiority is admitted. Hence the Yankees, whose livers are always out of order, their gastric juices in a state of chronic insurrection, and their bodies consequently dried up and cadaverous, like nothing so much as the huge and oleaginous. Many of them, with souls so little that some of their philosophers deny that there is a soul, are only happy when they are acting pilot-fish to a shark or jackal to a lion. Any sort of affinity to anything that is big makes them forget their own diminutiveness, and exult in the imagination that a pigmy becomes a giant when he is "perch'd on Alps."

It will be a dreadful blow to these manikins where they have to give up all hope of the big Union, and exchange the big profits proceeding therefrom for the pewter plates and pints pots of their primitive pillaring and cod fishery. Little New England, left to herself by both the South and West; can have no other recourse than to be tied like a tin pan to the tail of the British bull-dog. Even then, she could gratify her taste for the big by admiring the dimensions of the rump which honors her with its companionship. And even if denied that luxury, she can console herself with the big ruin which her fanaticism has brought upon the old government and upon her own fortunes, and cheer herself up every morning by seeing in her looking-glass a big fool.

The ocean and the dikes.

A traveler in Holland, during the peace of Amiens, says that one night while he was at one of the coast towns, there came a horrible roar of surge and billow and raving Boreas; so horrible, that even the phlegmatic Dutchmen were inclined to give it all up, and many of them sent their wives and children, goods and chattels, far into the interior, never doubting that the dike must give way and their whole town be swamped into annihilation. Next morning, however, the sun rose clear and bright, and when our traveler, among others, took courage to go down and examine the site of the anticipated breach, he found the dike stronger a million times than all the labor of half a dozen plodding centuries had ever been able to make it. The raging ocean, he says, had hurried before him such a mass of sturdy solid stuff that every heave it gave only added a new line of bulwark to the deserted barrier of trembling Mynheer, who, in consequence of that fortunate hurricane, has ever since rejoiced in a circumvallation that would defy a deluge. Ever afterwards, when the ocean looked hungrily at him over the dikes, or lashed itself into angry waves, he ate his sauerkraut with increased complacency, and felt very much obliged to the winds and waters for getting into such a passion.

The Confederate States have had a similar experience with the breakwaters which they built at the beginning of the war to keep out the flood of Yankee invasion. The barriers at first had such a fragile appearance, that when the Yankee hurricane began to rise in its wrath the despondent apprehended that the waves would make a clean sweep, and many of the inhabitants of the towns sent off their household gods to the interior. But, after the storm, came the sunshine, and it was discovered that the dikes waxed stronger in proportion to the strength of the storm. Fort Sumter by a year of siege has been rendered perfectly impregnable; and Richmond, whose weakness once seemed to invite assault, has become the Gibraltar of America, so that the London Times correspondent says no such earthwork fortifications are now to be found elsewhere in the world. We appreciate our obligations to Lee and Beauregard; but our principal benefactor is the Yankee ocean. With every fresh transport of its rage, new circumvallations rise,--the more force it sends, the more fortifications appear to resist it. If it will only work away with steady violence we shall see the whole South converted into one huge fortress.--Therefore, cease not, rude Boreas! With all Yankeedom storming at our doors, we go about our daily avocations with as much composure and regularity as the Dutch behind their impervious dikes, and snap our fingers at the Yankee ocean and the blue bellied sharks that are hungering for our destruction.

It is not alone in material fortifications that the fury of the Yankee elements has aided in throwing barriers in their own way which they will never be able to surmount. Whereas, at the beginning of the war, a humane military policy like that of McClellan might have undermined the constancy of some weak brethren; the emancipation, confiscation and extermination madness of Lincoln, aided by the horrible excesses of his brutal soldiery, has consolidated the whole Confederacy into one gigantic mountain of adamant, impervious alike to the breeze and the tornado, the rippling tide and the roaring billow, We tender our profound acknowledgments to the fanatic rage and remorseless cruelty which have rendered our security more secure, and our separation eternal. Let the sea and the tornado settle their accounts together. Between them they have made it a matter of indifference to us whether they live in concord and quietness or discontent and storm.
