 Richmond Dispatch. Monday morning...Dec. 16, 1861. Federal relations with foreign Powers.

Doubtless the proceeding has been the result of inadvertence. We feel ourselves at liberty to think that it would not have occurred if we had been so fortunate as to have been heard through you in the consolations of the French Government. We think we can easily see how the inadvertence occurred.--France seems to have mistaken a mere casual and ephemeral insurrection here, such as is incidental into the experience of all nations, because all nations are merely human societies, such as have sometimes happened in the history of France herself, for a war which has flagrantly separated this nation into two coexisting political powers which are contending in arms against each other after the separation.

It is erroneous, so far as foreign nations are concerned to suppose that any war exists in the United States. Certainly there cannot be two belligerent Powers where there is no war. There is here as there has always been, one political Power, namely — the United States of America--competent to make war and peace, and conduct commerce and alliances with all foreign nations. There is none other, either in fact or recognized by foreign nations. There is, indeed, an armed sedition seeking to overthrow the Government, and the Government is employing military and naval forces to repress it. But these facts do not constitute a war presenting two belligerent Powers, and modifying the national character, rights, and responsibilities, or the characters, rights, and responsibilities of foreign nations. It is true that insurrection may ripen into revolution, and that revolution thus ripened may extinguish a previously existing State, or divide it into one or more independent States, and that if such States continue their strife after such division, then there exists a State of war affecting the characters, rights, and duties of all parties concerned. But this only happens when the revolution has run its successful course.

The French Government says, in the instruction which has been tendered to us, that certain facts which it assumes confer upon the insurgents of this country, in the eyes of foreign powers, all the appearances of a government de facto, wherefore, whatever may be its regrets, the French Government must consider the two contending parties as employing the forces at their disposal in conformity with the laws of war.

This statement assumes not only that the law of nations entitles any insurrectionary taction, when it establishes a de facto government, to be treated as a belligerent, but also that the fact of the attainment of this status is to be determined by the appearance of it in the eyes of foreign nations. If we should concede both of these positions, we should still insist that the existence of a de facto government, entitled to belligerent rights, is not established in the present case. We have already heard from most of the foreign nations. There are only two which seem so to construe appearances, and France is one of them. Are the judgments of these two to outweigh those of all other nations. Doubtless each nation may judge and act for itself, but it certainly cannot expect the United States to accept its decision upon a question vital to their national existence.

The United States will not refine upon the question when and how new nations are born out of existing nations. They are well aware that the rights of the States involve their duties and their destinies, and they hold those rights to be absolute as against all foreign nations. These rights do not at all depend on the appearances which their condition may assume in the eyes of foreign nations, whether strangers, neutrals, friends, or even allies.--The United States will maintain and defend their sovereignty throughout the bounds of the republic, and they deem all other nations bound to respect that sovereignty until, if ever, Providence shall consent that it shall be successfully overthrown. Any system of public law or national morality that conflicts with this would resolve society, first in this hemisphere and then in the other, into anarchy and chaos.

This government is sensible of the importance of the step it has taken in declining to bear the communication, the tenor of which has drawn out these explanations. It believes, however, that it need not disturb the good relations which have so long and so happily subsisted between the United States and France.

The paper, as understood, while implying a disposition on the part of France to accord belligerent rights to their Sargents, does not name, specify or even indicate one such belligerent right. On the other hand, the rights which it asserts that France expects as a neutral, from the United States, as a belligerent, are even less than this Government, on the 25th of April, instructed you to concede and guarantee to her by treaty, as a friend. On that day we offered to her our adhesion to the declaration of Paris, which contains four propositions — namely: 1. That privateering shall be abolished. 2. That a neutral flag covers enemy's goods not contraband of war. 3. That goods of a neutral, not contraband, shall not be confiscated, though found in an enemy's vessel. 4. That blockades, in order to be lawful, must be maintained by competent force. We have always, when at war, conceded the three last of these rights to neutrals a fortiori, we could not when at peace deny them to friendly nations.

The first named concession was proposed on the grounds already mentioned. We are still ready to guarantee these rights by convention with France, whenever she shall authorize either you or her Minister here to enter into convention. There is no reservation or difficulty about their application in the present case. We hold all the citizens of the United States, loyal or disloyal, alike included by the law of nations and treaties; and we hold ourselves bound by the same obligations to see, so far as may be in our power, that all our citizens, whether maintaining this Government or engaged in overthrowing it, respect those rights in favor of France and of every other friendly nation. In any case, not only shall we allow no privateer or national vessel to violate the rights of friendly nations as I have thus described them, but we shall also employ all our naval force to prevent the insurgents from violating them, just as much as we do to prevent them from violating the laws of our own country.

What, then, does France claim of us that we do not accord to her? Nothing. What do we refuse to France by declining to receive the communication sent to us through the hands of Mr. Mercier? Nothing but the privilege of telling us that we are at war when we maintain we are at peace, and that she is neutral when we prefer to recognize her as a friend.

Of course, it is understood that on this occasion we reserve, as on all others, our right to suppress the insurrection by naval as well as by military power, and for that purpose to close such of our ports as have fallen or may fall into the hands of the insurgents, either directly or in the more lenient and equitable form of a blockade, which for the present we have adopted. It is thus seen that there is no practical subject of difference between the two governments. The United States will hope that France will not think it necessary to adhere to and practice upon the speculation concerning the condition of our internal affairs which she has proposed to communicate to us. But, however this may be, the United States will not anticipate any occasion for a change of the relations which, with scarcely any interruption, have existed between the two nations for three-quarters of a century, and have been very instrumental in promoting not merely the prosperity and greatness of each State, but the cause of civil and religious liberty and free institutions throughout the world.

This government understands equally the interest of friendly nations and its own in the present emergency. If they shall not interfere, the attempt at revolution here will cease without inflicting serious evils upon foreign nations. All that they can do by any interference, with a view to modify our action will only serve to prolong the present unpleasant condition of things, and possibly to produce results that would be as universally calamitous as they would be irretrievable.

The case, as it now stands, is the simple, ordinary one that has happened at all times and in all countries. A discontented domestic faction seeks foreign intervention to overthrow the Constitution and the liberties of its own country. Such intervention, if yielded is ultimately disastrous to the cause it is designed to aid. Every uncorrupted nation, in its deliberate movements, prefers its own integrity, even with unbearable evils, to division through the power or influence of any foreign State. This is so in France. It is not less so in this country. Down deep in the heart of the American people deeper than the love of trade or of freedom — deeper than the attachment to any local or sectional interest, or partisan pride or individual ambition — deeper than any other sentiment — is that out of which the constitution of this Union arose — namely, American independence — independence of all foreign control, alliance or influence. Next above it lies the conviction that neither peace, nor safety, nor public liberty, nor prosperity, nor greatness, nor empire, can be attained here with the sacrifice of the unity of the people of North America. Those who, in a frenzy of passion, are building expectations on other principles do not know what they are doing. Whenever one part of this Union shall be found assuming bonds of dependence or of fraternity towards any foreign people, to the exclusion of the sympathies of their native land, then, even if not before, that spirit will be reawakened which brought the States of this republic into existence, and which will preserve them united until the common destiny which it opened to them shall be fully and completely realized.

the position of the United States on the question — the action of England and France in regard to the treaty of Paris.--the Final Answer of Mr. Seward, &c.

In our edition of Friday last appeared a special telegraphic dispatch, briefly referring to the subjoined letter. We publish it entire, as it is a matter of some importance at this time:

Mr. Seward to Mr. Dayton. Department of State,Washington, Sept. 10, 1861. Sir:

Your dispatch of August 22. (No. 35) has been received. I learn from it that Mr. Thouvenel is unwilling to negotiate for an accession by the United States to the declaration of the Congress of Paris concerning the rights of neutrals in maritime war, except "on a distinct understanding that it is to have no bearing, directly or indirectly, on the question of the domestic difficulty now existing in our country," and that to render the matter certain, Mr. Thouvenel proposes to make a written declaration simultaneously with his execution of the projected convention for that accession.

You have sent me a copy of a note to this effect, addressed to you by Mr. Thouvenel and have also represented to me an official conversation which he has held with you upon the same subject. The declaration which Mr. Thouvenel thus proposes to make is in these words:

Draft of declaration.

In affixing his signature to the convention concluded on date of this day between France and the United States, the undersigned declares, in execution of the orders of the Emperor, that the Government of his Majesty does not intend to undertake by the said convention any engagements of a nature to implicate it, directly or indirectly, in the internal conflict now existing in the United States.

My dispatch of the 17th day of August last, (No. 41,) which you must have received some time ago, will already have prepared you to expect my approval of the decision to wait for specific instructions in this new emergency at which you have arrived.

The obscurity of the text of the declaration which Mr. Thouvenel submits to us is sufficiently relieved by his verbal explanations.--According to your report of the conversation, before referred to, he said that both France and Great Britain had already announced that they would take no part in our domestic controversy, and they thought a frank and open declaration in advance of the execution of the projected convention might save difficulty and misconception hereafter. He further said, in the way of specification, that the provisions of the convention standing alone might bind England and France to pursue and punish the privateers of the South as pirates; that they are unwilling to do this, and had so declared. He said, also, that we could deal with these people as we choose, and they (England and France) could only express their regrets on the score of humanity, if we should deal with them as pirates, but that they could not participate in such a course. He added that although England and France are anxious to have adhesion of the United States to the declaration of Paris, yet that they would rather dispense with it altogether than be drawn into our domestic controversy. He insisted somewhat pointedly that we could take no just exception to this outside declaration, to be made simultaneously with the execution of the convention, unless we intended that they (England and France) shall be made parties to our controversy, and that the very facts of your hesitation was an additional reason why they should insist upon making such contemporaneous declarations as they proposed.

These remarks of Mr. Thouvenel are certainly distinguished by entire frankness. It shall be my effort to reply to them with moderation and candor.

In 1856 France, Great Britain, Russia, Prussia, Sardinia, and Turkey, being assembled in Congress at Paris, with a view to modify the law of nations so as to meliorate the evils of maritime war, adopted and set forth a declaration, which is in the following words:--

1. Privateering is and remains abolished. 2. The neutral flag covers enemy's goods, with the exception of contraband of war. 3. Neutral goods, with the exception of contraband of war, are not liable to capture under enemy's flag. 4. Blockades, in order to be binding, must be effective — that is to say, maintained by forces sufficient really to prevent access to the coast of the enemy.

The States which constituted the Congress mutually agreed to submit the declaration to all other nations, and invite them to accede to it. It was to be submitted as no special or narrow treaty between particular States for limited or special purposes of advantage, or under peculiar circumstances; but, on the contrary, its several articles were by voluntary acceptance by maritime powers to constitute a new chapter in the law of nations, and each one of the articles was to be universal and eternal in its application and obligation. France especially invited the United States to accede to these articles. An invitation was actually tendered to all other civilized nations, and the articles have been already adopted by forty-one of the powers thus invited. The United States hesitated, but only for the purpose of making an effort to induce the other parties to enlarge the beneficent scope of the declaration.

Having failed in that effort, they now, after a delay not unusual in such great international discussions, offer their adhesion to that declaration, pure and simple, in the form, words and manner in which it was originally adopted and accepted by all of the forty-six nations which have become parties to it. France declines to receive that adhesion unless she be allowed to make a special declaration, which would constitute an additional and qualifying article, limiting the obligations of France to the United States to a narrower range than the obligations which the United States must assume towards France and towards every other one of the forty-six sovereigns who are parties to it, and narrower than the mutual obligations of all those parties, including France herself.

If we should accede to that condition, it manifestly would not be the declaration of the Congress of Paris to which we would be adhering, but a different and special and peculiar treaty between France and the United States only. Even as such a treaty it would be unequal. Assuming that Mr. Thouvenel's reasoning is correct, we should, in that case, be contracting an obligation, directly or indirectly, to implicate ourselves in any internal conflict that may now be existing, or that may hereafter occur in France, while she would be distinctly excused by us from any similar duty towards the United States.

I know that France is a friend, and means to be just and equal towards the United States. I must assume, therefore, that she means not to make an exceptional arrangement with us, but to carry out the same arrangement in her interpretation of the obligations of the declaration of the Congress of Paris in regard to other Powers. Thus carried out, the declaration of Paris would be expounded so as to excclude all internal conflicts in States from the application of the articles of that celebrated declaration. Most of the wars of modern times — perhaps of all times — have been insurrectionary wars, or "internal conflicts." If the position now assumed by France should thus be taken by all the other parties to the declaration, then it would follow that the first article of that instrument, instead of being, in fact, a universal and effectual inhibition of the practice of privateering, would abrogate it only in wars between foreign nations, while it would enjoy universal toleration in civil and social wars.

With great deference I cannot but think that, thus modified, the declaration of the Congress of Paris would lose much of the reverence which it has hitherto received from Christian nations. If it were proper for me to pursue the argument further, I might add that addition, insurrection and treason would find in such a new reading of the declaration of Paris, encouragement which would tend to render the most stable and even the most beneficent systems of government insecure. Nor do I know on what grounds it can be contended that practices more destructive to property and life ought to be tolerated in civil or fratricidal wars than are allowed in wars between independent nations.

I cannot, indeed, admit that the engagement which France is required to make, without the qualifying declaration in question, would directly or indirectly implicate her in our internal conflicts. But if such should be its effect, I must, in the first place, disclaim any desire for such an intervention on the part of the United States. The whole of this long correspondence has had for one of its objects the purpose of averting any such intervention. If, however, such an intervention would be the result of the unqualified execution of the Convention by France, then the fault clearly must be inherent in the declaration of the Congress of Paris itself, and it is not a result of anything that the United States have done or proposed.

Two motives induced them to tender their adhesion, to that declaration--first, a sincere desire to co-operate with other progressive nations in the amelioration of the rigors of maritime war; second, a desire to relieve France from any apprehension of danger to the lives or property of her people from violence to occur in the course of the civil conflict in which we are engaged, by giving her, unasked, all the guarantees in that respect which are contained in the declaration of the Congress of Paris. The latter of those two motives is now put to rest, insomuch as France declines the guarantees we offer.--Doubtless she is satisfied that they are unnecessary. We have always practiced on the principles of the declaration. We did so long before they were adopted by the Congress of Paris, so far as the right of neutrals or friendly States are concerned. While our relations with France remain as they now are, we shall continue the same practice none the less faithfully than if bound to do so by a solemn convention.

The other and higher motive will remain unsatisfied, and it will lose none of its force. We shall be ready to accede to the declaration of Paris with every Power that will agree to adopt its principles for the government of its relations to us, and which shall be content to accept our adhesion on the same basis upon which all the other parties to it have acceded.

We know that France has a high and generous ambition. We shall wait for her to accept hereafter that co-operation, on our part, in a great reform which she now declines. We shall not doubt that, when the present embarrassment which causes her to decline this co-operation shall have been removed, as it soon will be, she will then agree with us to go still further, and abolish the confiscation of property of non-belligerent citizens and subjects in maritime war.

You will inform Mr. Thouvenel that the proposed declaration, on the part of the Emperor, is deemed inadmissible by the President of the United States; and if it shall be insisted upon, you will then inform him that you are instructed for the present to desist from further negotiations on the subject involved.

I am, sir, your obedient servant, William H. Seward. Wm. L. Dayton, Esq., &c., &c., &c. A Biographical sketch of Marble Nash Taylor.

As the name of this man has been brought rather prominently before the public of late, in the character of Provisional Governor of North Carolina, we deem it not inappropriate to transfer to our columns the following sketch, which we copy from the Norfolk Day Book, of the 12th inst.:

Marble Nash Taylor is one of the most despicable of the human family — hated alike by God and man, and for the reason that he employs the garb of religion to cover the rottenness of his depraved and corrupt heart. So pious did this treacherous hypocrite become at one time, that nothing would do but that he must preach the gospel. He saw very clearly that if he could assume the character of a minister, he would secure a confidence which would enable him the more easily to practice his deeds of infamy and vice. Accordingly he applied for admission in the Baptist Church, and asked to be ordained a preacher. Fortunately, the body to whom he applied knew more of his perfidious character than he thought they knew, and they unhesitatingly rejected him. Failing here, but still ambitious to serve his father, the devil, this hypocritical fiend applied for admission into the Methodist Conference. He was comparatively a stranger to them; they knew but little of his real character, and as he wigged a pious tongue, and wore a saintly countenance, they consented to receive him on trial. His term of probation, though short, was sufficiently long to reveal him in his true character. So given was he to deeds of darkness, that he could not, even to gratify his unholy ambition, restrain himself sufficiently long to be taken in full connection with that body. He was found to be a black-hearted hypocrite who desecrated the name and character of the minister of God, and he was speedily ousted from the Conference, and his license to preach taken away from him. --Nothing daunted, fully determined upon his unholy purpose, and finding that he must seek another field for operation, he hailed the breaking out of the war as a happy occurrence, and saw in it an opportunity of gratifying his base designs. He joined a company, and then went to work to demonstrate the great necessity which existed for a chaplain. He suggested himself as a proper person to perform the duties of that office, and by some hocus pocus succeeded in obtaining the appointment, and was sent to Hatteras.

Marble Nash Taylor was now a chaplain in the Confederate States Army — prayed for the success of the Confederate arms — declared over an open Bible that the South was right and exhorted his hearers to die rather than surrender a cause so holy as that in which they were engaged. But the enemy came, and this fiend was afforded another opportunity of displaying his hypocrisy. On their near approach he watched his chance and stood upon the beach and signalized them.--He was understood; a boat was sent, and this contemptible apology for a man who had, while pretending to be a minister of the gospel, declared the South to be right, and prayed for the success of her arms, gave the lie to himself, and deliberately and willfully declared that he had used the sacred office of the ministry and the Holy Word of God deceitfully, by going over to that enemy and joining hands with him. This is Marble Nash Taylor, Provisional Governor of North Carolina. This is the scamp who dares to issue a proclamation to the people of that good old State, calling upon them to become as base and perfidious as himself, and renew their alliance to the United States! This is the villain whose acquisition by the Rump is so rejoiced over at the North, and whom the Northern Government so delights to honor. And why? Because, as we intimated in the outset, they need villains to carry on their work of shame, and Marble Nash Taylor is a villain!

A Federal launch on the Attakapas Coast — capture of the Confederate Schr. Purdy.

The Planters' (

.) Banner gives the following particulars of the capture of the Confederate schooner Purdy, by a launch belonging to the blockading frigate Santee:

Last Friday , the 29th inst., the Confederate schooner Purdy, Capt. Collins, while lying at the mouth of Belle Isle bayou, was suddenly boarded by eight Lincolnites from a launch belonging as they stated to the U. S. frigate Santee. They were armed with six Minnie rifles, eight cutlasses and a brace of pistols each. They also had a 3-pounder aboard ready for action. The Purdy had on board three men, Capt. Collins, John Denniston and M. B. Gordy, and a small boy. They had three double-barrel shot guns, a revolver and a 2-pounder which was below.

The captain of the launch demanded the surrender of the Purdy, and when Capt. Collins cocked his gun, and stated that he doubted whether he would accede to the demand, all the Lincoln guns were promptly leveled upon him and his companions preparatory to enforcing the request. Capt. Collins saw the folly of resisting under the circumstances, and reluctantly permitted the piratical crew to take charge of his vessel. They permitted Capt. C. to take most of the articles he wished from his vessel, and to go ashore with his three companions. As soon as these arrangements were completed, the Lincolnites left with their prize, moving to the southeast.

About three hours after this Capt. Samuel Parker came within hailing distance from Belle Isle with the sloop Florida, belonging J. M. Wafford, and had with him two other men. Capt. Collins and his men immediately joined them and they started to recapture the Purdy. They were badly armed, and had but six men against eight Lincolnites. But what they lacked in weapons and men they made up in pluck and strategy. They had a pump aboard which they masked, all but the end, which was a fine imitation of the muzzle of a 6-pounder, and with a hole or two in the sail, which indicated that they had been shot at, they doubtless passed for a privateer, and looked rather savage to the thieving crew, upon whom they were now rapidly gaining. The Purdy was at length run on a reef, and the Lincolnites in hot haste abandoned her and took to their launch, plying their cars lustily to avoid being captured by their resolute pursuers. They left the Purdy in such fearful haste that they left behind them twelve cartridge boxes, two pistols, seven cutlass sheaths, a dozen belts and a letter which had just been written by one of the crew, giving a thrilling account of a fearful fight in which they had just engaged, killing, wounding and taking prisoners about twenty rebels, besides capturing their vessel.

The launch and its crew would have been finally captured but for a misunderstanding in the signals exchanged between the Florida and a launch of the Confederate steamer Mobile, with which they attempted to communicate, after the recapture of the Purdy.

It appears that a launch of about the size of the above, which was 25 feet long, with eight oars and eight men, had landed on an island west of Belle Isle a few days previous to this, and there were various speculations in regard to what vessel they belonged to.--They landed on a stealing expedition. It appears also that they had been ashore at Belle Isle the day previous to the capture of the Purdy.

Ex-Governor Stewart knocked down and his hands tied behind him.

--The Bowling Green (Ky.) Courier, of the 10th inst., says:

"Ex-Governor Stewart, on passing to the Palee House, in St. Joseph, Mo., had to cross a bridge; while on which he was knocked down, his hands tied behind him, and what the reporter calls a shameless indignity' offered him. He was released by a party of the 15th Illinois, unbound, and then — run away with standing hair from his own friends."

Report of Capt. Wilkes.why he did not seize the Trent.

The following is the report of Capt. Wilkes, assigning his reasons for the arrest of Messrs. Mason and Slidell:

U. S. Steamer San Jacinto, At Sea, Nov. 16. Sir:

--In my dispatch by Commander Taylor I confined myself to the reports of the movement of this ship, and the facts connected with the capture of Messrs. Mason, Slidell, Eustis, and Macfarland, as I intended to write you particularly relative to the reasons which induced my action in making these prisoners.

When I heard at Cienfuegos, on the south side of Cuba, of these Commissioners having landed on the Island of Cuba, and that they were at Havana, and would depart in the English steamer of the 7th of November, I determined to intercept them, and carefully examined all the authorities on international law to which I had access, viz: Kent Wheaton, Vattel, besides various decisions of Sir William Scott, and other judges of the Admiralty Court of Great Britain, which bore upon the rights of neutrals and their responsibilities.

The Governments of Great Britain, France and Spain have issued proclamations that the Confederate States were viewed, considered, and treated as belligerents, and knowing that the ports of Great Britain, France, Spain, and Holland, in the West Indies, were open to their vessels, and that they were admitted to all the courtesies and protection vessels of the United States receive, every aid and attention being given them, proved clearly that they acted upon this view and decision, and brought them within the international law of search and under the responsibilities. I therefore felt no hesitation in boarding and searching all vessels of whatever nation I fell in with, and have done so.

The question arose in my mind whether I had the right to capture the persons of these commissioners — whether they were amenable to capture. There was no doubt I had the right to capture vessels with written dispatches — they are expressly referred to in all authorities, subjecting the vessel to seizure and condemnation if the captain of the vessel had the knowledge of their being on board. But these gentlemen were not dispatches in the literal sense, and did not seem to come under that designation, and nowhere could I find a case in point.

That they were commissioners I had ample proof from their own avowal, and bent on mischievous and traitorous errands against our country — to overthrow its institutions and enter into treaties and alliances with foreign States, expressly forbidden by the Constitution.

They had been presented to the Captain-General of Cuba by H. B. M. Consul General, but the Captain-General told me he had not received them in that capacity, but as distinguished gentlemen and strangers.

I then considered them as the embodiment of dispatches, and as they had openly declared themselves as charged with all authority from the Confederate Government to form treaties and alliances tending to the establishment of their independence, I became satisfied that their mission was adverse and criminal to the Union, and it, therefore, became my duty to arrest their progress and capture them, if they had no passports or papers from the Federal Government, as provided for under the law of nations, viz:--"That foreign ministers of a belligerent on board of neutral ships are required to possess papers from the other belligerent to permit them to pass free."

Report and assumption gave them the title of Ministers to France and England, but inasmuch as they had not been received by either of these powers, I did not conceive they had immunity attached to their persons, and were but escaped conspirators, plotting and contriving to overthrow the Government of the U. States, and they were therefore not to be considered as having any claim to the immunities attached to the character they thought fit to assume.

As respects the steamer in which they embarked, I ascertained in the Havana that she was a merchant vessel plying between Vera Cruz, the Havana and St. Thomas, carrying the mail by contract.

The agent of the vessel, the son of the British Consul at Havana, was well aware of the character of these persons, that they engaged their passage and did embark in the vessel; his father had visited them, and introduced them as ministers of the Confederate States, on their way to England and France.

They went in the steamer with the knowledge and consent of the captain, who endeavored afterwards to conceal them by refusing to exhibit the passenger list, and the papers of the vessel. There can be no doubt he knew they were carrying highly important dispatches, and were endowed with instructions inimical to the United States. This rendered his vessel (a neutral) a good prize, and I determined to take possession of her, and, as I mentioned in my report, send her to Key West for adjudication, where, I am well satisfied, she would have been condemned for carrying these persons, and for resisting to be searched; the cargo was also liable as all the shippers were known to the embarkation of these live dispatches, and their traitorous motives and actions to the Union of the United States.

I forbore to seize her, however, in consequence of my being so reduced in officers and crew, and the derangement it would cause innocent persons, there being a large number of passengers, who would have been put to great loss and inconvenience, as well as disappointment, from the interruption it would have caused them in not being able to join the steamer from St. Thomas for Europe. I, therefore, concluded to sacrifice the interests of my officers and crew in the prize, and suffered the steamer to proceed after the necessary detention to effect the transfer to these Commissioners, considering I had obtained the important end I had in view, and which affected the interests of our country, and interrupted the action of that of the Confederates.

I would add that the conduct of H. B. M. 's subjects, both official and others, showed but little regard or obedience to her proclamation, by aiding and abetting the views and endeavoring to conceal the persons of the Commissioners.

I have pointed out sufficient reasons to show you that my action in this case was derived from a firm conviction that it became my duty to make these parties prisoners, and to bring them to the United States.

Although in my giving up this valuable prize I have deprived the officers and crew of a well-earned reward, I am assured they are quite content to forego any advantages which might have accrued to them under the circumstances.

I may add that having assumed the responsibility, I am willing to abide the result.

The following is a copy of the orders issued by Captain Wilkes, of the San Jacinto, to Lieut. Fairfax, executive officer of that vessel, for the arrest of Messrs. Mason and Slidell:

"U. S. Steamer San Jacinto, At Sea, Nov. 8, 1861. "Sir:

You will have the second and third cutters of this ship fully manned and armed, and be, in all respects, prepared to board the steamer Trent, now hove to under our guns.

"On boarding her you will demand the papers of the steamer, her clearance from Havana, with the list of passengers and crew.

"Should Mr. Mason, Mr. Slidell, Mr. Eustis and Mr. Macfarland be on board, you will make them prisoners, and send them on board this ship immediately, and take possession of her as a prize.

"I do not deem it will be necessary to use force — that the prisoners will have the good sense to avoid any necessity for using it; but, if they should, they must be made to understand that it is their own fault. They must be brought on board.

"All trunks, cases, packages and bags belonging to them, you will take possession of and send on board of this ship. Any dispatches found on the persons of the prisoners, or in possession of those on board the steamer, will be taken possession of also, examined, and retained if necessary.

"I have understood that the families of these gentlemen may be with them; if so, I beg you will offer some of them, in my name, a passage in this ship to the United States, and that all the attentions and comforts we can command are tendered them, and will be placed at their service.

"In the event of their acceptance, should there be anything which the captain of the steamer can spare to increase the comforts in the way of necessaries or stores, of which a war vessel is deficient, you will please to procure them; the amount will be paid for by the paymaster.

"Lieut. James A. Greer will take charge of the third cutter, which accompanies you, and will assist you in these duties.

"I trust that all those under your command, in executing this important and delicate duty, will conduct themselves with all the delicacy and kindness which becomes the character of our naval service.

"I am, very respectfully, "Your obedient servant, (Signed,) "Charles Wilkes, "Captain, "Lieut. D. M. Fairfax, U. S. Navy, Executive Officer, San Jacinto." Later from Kentucky.

important proceedings of the Kentucky Union Legislature — resolutions offered Recognizing property in slaves, &c.

The Bowling Green (Ky.) Courier, of the 10th inst., says that a number of professed Union men, alias Yankees, falsely assuming to represent the people of Kentucky, and styling themselves the Legislature, who were bought by Lincoln with a price, are now in session at Frankfort, obeying the Despot's orders, and doing his dirty work generally. The following is a short synopsis of their proceedings of the 29th and 30th of November:

In the House of Representatives bills were introduced exempting soldiers now in Lincoln's service from the payment of the county levy for the year 1862; providing that attachments shall not issue against Lincoln soldiers because of absence from the State four months; and providing that no person aiding and assisting the rebellion against King Lincoln shall ever hold any office of trust or profit in this Commonwealth.

John B. Huston "threw a spratt to catch a whale," by offering a bill requesting Congress to grant relief to starving Ireland. It was adopted.

Resolutions were introduced and referred, denouncing the Provisional Government movement, declaring it treason, and instructing Gov. Magoffin to issue his proclamation warning the people against assisting it, and requiring those already engaged in carrying it on to disband and desist from their purposes.

A bill authorizing a majority of the stockholders of the People's Bank to remove the bank from Bowling Green to Louisville, passed.

A bill allowing the Bank of Ashland to issue notes of a less denomination than five dollars, passed.

We take the following proceedings of the Kentucky Legislature of the 3d inst., from the Cincinnati Commercial, of the 5th of December.

Mr. Allen offered a series of resolutions, from which we extract the following:

Resolved, That all the citizens of Kentucky who are in arms against the National Government, are guilty of treason according to the tenets of every political party that ever existed in this nation.

Resolved, That slaves are property, and as such, according to the uniform rule and practice of civilized warfare, are subject to capture and confiscation when their owners are in arms against the Government; and while Kentucky cannot complain of their capture and confiscation, she will not consent or approve of their emancipation when so captured.

Resolved, That in our opinion, the best disposition that can be made of slaves so captured, is to turn them over to the loyal slave States, to be by them disposed of.

Resolved, That the use of captured slaves to work upon fortifications, etc., is not improper; but we unqualifiedly condemn and oppose the arming of slaves to fight in behalf of the Government.

Resolved, That the capture of Mason and Slidell is approved, and was in accordance with international law.

Resolved, That if we understand the sole object of the present war, it is to maintain the unity and integrity of the nation, and to restore its authority over the whole territory; and should the national authorities, during its progress, madly make it a war against the institution of slavery, it will then become the right and duty of Kentucky to resist, and she will resist.

These resolutions were laid over under the rules. We believe they have not yet been voted upon.

The Frankfort Commonwealth reports the following proceedings of the Senate on the 2d instant:

Mr. Prall--Federal relations — reported "a resolution in relation to the position of Kentucky in the existing war." Said resolution is as follows, viz:

Resolved, by the General Assembly of the Commonwealth of Kentucky, That Kentucky has ever cherished and adhered to the Federal Union, and she will cling to it now, in this time of its extremest peril, with unfaltering devotion. While at the beginning of the mad and wicked war which is being waged by the rebellious States for the destruction of the Government she forbore to take part in the hope that she midht interpose her friendly offices in the interests of peace, she has nevertheless sternly repelled every movement which looked to a change of her political relations, and has never swerved from her full and fervid loyalty to the noblest and freest Government in the world. And now, since her proffered mediation has been spurned, and her soil invaded by the Confederate armies, she deems it fit that she should announce to the world that standing firmly by her Government, she will resist every effort to destroy it, and she calls upon her true and heroic sons to rally around the standard of their country, and put forth the whole energies of the Commonwealth till the rebellion shall be overthrown, and the just supremacy of the National Government shall be restored and maintained everywhere within its limits.

Mr. Prall addressed the Senate at length in support of the resolution.

The resolution was then adopted by yeas 21, noes 1.

Mr. Grover only voting in the negative.

The following resolutions were introduced in the House on Monday:

Mr. Burns offered the following preamble and joint resolution, which lies one day on the table, viz:

Whereas, C. S. Morehead, M. W. Barr, and R. T. Durrett, citizens of the State of Kentucky, have been forcibly seized, without warrant of law, by order of the Federal Government, and taken beyond the jurisdiction of this Commonwealth, and are now incarcerated in the military forts of the United States: Therefore,

Resolved, by the General Assembly of the Commonwealth of Kentucky, That the Governor of this Commonwealth is hereby requested to demand of the President of the United States the immediate delivery of the citizens of Kentucky aforesaid in the custody of the United States Court for the district of Kentucky that charges may be preferred against them, if they have committed any offence against the laws of the United States, and they may have a speedy and impartial trial, as prescribed by the Constitution of the State of Kentucky.

The execution of a bridge-burner in Knoxville.

--We have already noticed the execution of C. A. Hann, of Green's county, Tenn., engaged in burning the Lick Creek Bridge. The Knoxville Register, of the 12th inst., in referring to the execution, says:

The prisoner was escorted from the jail by a military guard, and met his fate with hardihood. He confessed, upon the scaffold, that he had been engaged in the incendiarism of the bridge — the proof of which, indeed, was full and positive before the court — and said that, under similar circumstances, he would do it again.

The conspiracy in Arkansas.

--The Little Rock Journal, of the 3d instant, says:

Col. Jerome B. Lewis, who has for some time had in charge those engaged in the conspiracy in the northern counties of this State, arrived in town day before yesterday, and reports that, in addition to the twenty-seven prisoners confined in the prison here, he holds one hundred and twenty under guard--seventy-three in Searcey county and forty-seven in Izzard. He left officers making arrests, and supposes there are between six and eight hundred belonging to the organization engaged in the conspiracy.

A youthful Hero.

--From the Charleston Mercury, of the 11th inst., we take the following:

Master James O. A. McDowell, who celebrated his twelfth birthday last September, in Virginia, where he has been on active service as market for the Chester Guards, for the past five months, reached his native home, Charleston, yesterday morning. The youthful soldier has, during his service, seen more active military life than many a gray-haired veteran. He participated in the battle of Manassas, and was also prominent in sundry skirmishes and hairbreadth escapes.

Election of a Bank officer.

--Dr. F. Preston Wellford was, on Wednesday last, chosen by the Directors of the Farmers' Bank of Virginia to fill the vacancy in the office of book-keeper, occasioned by the dedeclension of Capt. Robert S. Chew, previously elected to the same office, who remains with his company.--Fredericksburg Recorder, 13th.

Yankees in Marion jail.

--There are nineteen Yankee prisoners in jail at Marion C. H., S. C. They profess a willingness to volunteer in the Confederate army; but Carolinians have very little confidence in Yankee professions.

Affairs at the South.

We make up the following summary of Southern news from late exchanges received at this office:

Late and interesting from Missouri--arrival of Camp Jackson prisoners — movements of Gen. Price, &c.

From the Memphis Avalanche, of the 10th inst., we extract the following interesting particulars in regard to affairs in Missouri:

The Camp Jackson prisoners, some sixty-five in number, accompanied by Gen. Frost, reached the city on the steamer Kentucky, from Columbus yesterday morning. They left St. Louis on the 2d Dec., and according to agreement, they were to be sent directly to Gen. Price's army; but on getting them at the Pacific Depot, they were informed that they had to go by way of Cairo, and after requiring each of them to take an oath as long as the moral law, they were marched aboard the Iatan and taken to Cairo, and thence, under flag of truce, to Columbus. They say before the prisoners left St. Louis, the ladies of the city, all of whom are warm sympathizers with the South, sent an abundance of provisions, besides little articles of clothing, such as socks, handkerchiefs, etc., for them. But the Federals, true to their instincts, took their little articles of clothing as contraband, and all their provisions they took off the boat at Cairo.

The scene on leaving St. Louis was grand. Not less than five thousand people — men, women, and children — followed the brave men to the river bank, and huzzled and cheered them on even in the face of Federal bayonets. Indeed it was not known till the day these men left, that there were so many friends of the Southern cause in St. Louis.--Even the St. Louis Democrat was taken all aback by the Southern demonstrations, and thus growls out its dissatisfaction:

The steamer Iatan, on board of which the prisoners were marched, at the foot of

, departed for Cairo at about , the friends of the heroes cheering lustily as the boat dropped out into the river. There should have been a small squad of cavalry present to have dispersed the traitorous crowd. It is strange, passing strange, that this class of people are allowed such frequent and public expression of their detestable sentiments.

The Camp Jackson boys design raising a battalion of Missourians for active service, and have already received considerable accessions since their arrival here.

We learn that a gentleman from General Price's army in the city yesterday, gives it as his opinion that General Price will go to Leavenworth and capture enough arms to put a gun in the hands of all his army, take the St. Joseph Railroad, and thus cut off all supplies to St. Louis, compelling them to surrender at discretion.

We conversed last evening with a gentleman perfectly familiar with army movements in Missouri, and from him gleaned many facts in the highest degree creditable to Gen. Price as a General and a high-toned gentleman. We are perfectly satisfied that Gen. Price has done all that a good General and brave man could have done under the circumstances, and trust that his future may be like the past only more abundant in results to our cause. We are informed that there has never been any difficulty about his procuring men — the only obstacle has been arms. These he is now getting in abundance, and with them his career will be prolific of happy results.

A Lincolnite in Lynchburg.

A man who gave his name as Summer Grazier, and who says he is a Tennessean, was arrested yesterday by some soldiers, while uttering treasonable expressions.--Among other things, he was heard to say that the city of Lynchburg ought to be burned down, and that every man who had taken up arms against Lincoln should be hung. These, with other like expressions, caused his arrest. Upon examining papers found on his person, reason was found for the suspicion that he had been a soldier in the Lincoln army, and had very recently visited the city of Washington. In fact, it is stated that the prisoner himself boldly proclaimed the fact that he had fought for old Abe, and expected to do so again. He was committed to jail to await further developments in his case. Should the charge against him prove true, he will no doubt test the strength of Southern hemp.

Appearance of Lincolnites near Belmont and their Subsequent retreat.

From the Confederate News, of Columbus, Ky., of the 9th instant, we take the following:

We learn that 300 Hessians made their appearance on the opposite side of the river Friday , on the battle ground of Belmont. Their stay was short, as our boys got after the cavalry scoundrels and made them leave at the rate of 2.40. We are glad to learn that four of the enemy bit the dust, and the balance, we doubt not, are now in the land of Egyptian darkness, surrounded by their "hoosiers" and "suckers," telling them of their miraculous escape from the Turtle-clutches of the infuriated rebels!

An Exploit near Evansport.

a day's Adventure of a Tennessee Company--capture of Yankees — the compromise resolutions advocated in Congress, &c.

[correspondence of the Richmond Dispatch.] Camp Dave Cuiren, Near Fredericksburg, Va., Dec. 9.

Will you allow a volunteer space in your columns to give the day's adventures of Captain Tom White, Company F, 2d Regiment of Tennessee Volunteers, (Col. Wm. B. Bate,) accompanied by J. N. McKendree, and L. M. Patterson, Company K, Sumner Greys! While strolling upon the banks of the Potomac, near Evansport, they discovered a small boat, a mile in the distance, evidently steering in the direction of the Virginia shore, containing three men and two small boys.--They were soon within a half mile of land, when they halted, and could be distinctly heard in loud conversation. They were very inquisitive in regard to how we were pleased with soldiering, our pay per month, our comfort as regarded clothing, &c. We answered all questions, gaining similar information from them. They were, or feigned to be, quite tired of the war. When informed by our party that our rations were abundant and our beds of cotton, they replied that their rations were insufficient and their bed the cold ground, and their pay very irregular.--They were charmed by the rebels' manner of speech, or by an occasional health drank to them, and were prevailed on to risk their little bark and valuable cargo still nearer the Virginia bank. They again halted in one-fourth of a mile of our little party. Upon being asked for news they replied, that they had learned from papers of the 8th, that Congress advocated a compromise, and they looked forward with pleasure to an early settlement of the existing difficulties; all of which we took for what it was worth, and insisted on them to land and pass a few moments with us. They asked for friends in the regiment whom we knew. They were apparently delighted to gain information from friends they so highly esteemed, and, either in forgetfulness of their own safety or nerved by a canteen of Dean's Ohio, (which they did ample justice,) they were soon within two hundred yards of the bank. They again halted and asked for evidence that they would not be harmed, which, of course, was given. They were soon so near the shore that Capt. White, accompanied by McKendree, waded in to give them a hearty welcome, and assist them ashore. They soon set Yankee feet on Virginia soil, and were in a hurry to return to occupy their posts as picket guard, upon which we informed them that we would be under the painful necessity of detaining them until Col. Bate should arrive. He was soon with us, and to their utter astonishment, ordered a guard to attend them to his quarters, where they remained a short time, and were guarded to the quarters of Gen. French, to be disposed of as he may suggest. The boys are sons of Capt. Wilkinson and Lieut. Smith, 1st New York regiment, and Excelsior Brigade, General Sickles. The names of the men are not remembered. They are of the 5th N. Y. Regiment, same brigade; all very intelligent — the boys especially. The boys are perfectly satisfied; the men would gladly rue their bargain Sumner.

Richmond Dispatch. Monday morning....Dec. 16, 1861. The partitioning of Virginia.

--When the Emperor Leopold was on a visit to his Italian dominions, in the year 1791, he had an interview with Lord Elgin, envoy from the younger Pitt, at that time Premier of Great Britain, and M. Bischofswerder, envoy of the King of Prussia, the object of which was to concert a plan for the dismemberment of France, then agitated by the throes of that mighty Revolution which threw down all the old landmarks of nations, and shook Europe from its centre to its circumference, as though it had been smitten by an earthquake. In conformity with the views expressed at that interview, it was asserted at the time, and was no doubt true, that the Emperor of Germany and the King of Prussia, at an interview held at Pilnitz a few months after, (July, 1792,) actually signed a treaty to the effect indicated. In pursuance of this treaty, the Duke of Brunswick and the King of Prussia entered France with an army of 110,000 men within less than a mouth after; and the former, disguising his real object under the pretence of interfering in favor of Louis XVI., issued his famous proclamation, in which he threatened to put every Frenchman who took up arms in defence of the soil on which he was born to an ignominious death, if taken. In a few months after, the head of the King in whose cause this crusade was professedly undertaken was rolling in the saw-dust of the Place de la Concorde, the army which had been relied on to enforce the bloody threat was flying before the young recruits of France, after having lost one-half of its force; the King who had headed the expedition was a suppliant for mercy at the hands of those he had threatened to exterminate; and the Duke of Brunswick was on his way to his own dominions, baffled, defeated, dispirited, humbled stripped of the laurels acquired by a life of hard service; and despised by the very soldiers he had so lately been hounding on to massacre and plunder. Louis XVI. was not restored, the French youth were not intimidated, France was not dismembered.

It is, to us, a matter of astonishment that a lesson so fraught with instruction, should have been utterly lost upon Secretary Cameron when he advised the dismemberment of Virginia, or should not be remembered by Congress when they are about to pass a law in accordance with his recommendation. It the very moment that the Secretary is giving this advice, his grand army is cooped up in Washington, and its vicinity, without the courage to advance upon the territory it is to dispose of after a fashion so summary, and the fleet of which his brother secretary boasts so loudly, dare not attempt to force the passage of the Potomac. On two occasions they have ventured to poke their noses be yond their fortifications, and on both they have been handled in such a manner that their spirit has been utterly cowed. All history may be searched in vain for a rout so utterly disgraceful as that of Manassas; all history, since the battle of Cannie, fails to record a slaughter so terrible as that of Leesburg.--And yet, while Yankee pride is still smarting under the unredeemed disgrace of these successive defeats, and while their effect upon Yankee soldiers is so appalling that they dare not face their terrible enemy in the field, a Yankee Secretary recommends, and a Yankee Congress is prepared to approve, the partition of the very country in which reside those men who chased them like hanted hares, when they ventured beyond their fortifications and who now hold them close prisoners in their stronghold. We do not recollect ever to have heard or read of anything quite so ridiculous. The thundering proclamations of the Chinese Mandarins, and their threats against the French and English "Rebels," are by no means fit to be mentioned as parallel absurdities. The King of Dahomey, when he rises up from his dinner, and announces his permission to all the monarchs of the earth to dine since his own repast has been conclude, is, no doubt, a tolerably ludicrous object. But he is beaten so far by his Yankee rivals, that it is hardly worth while to mention him in the same breath.

The New York Herald, the most obsequious of slaves to the dynasty that has put its heel upon the neck of Yankeedom, echoes the threats of the Secretary with ferocious glee. "His plan," it says, "is to dismember the rebel portions of that State, (Virginia,) and to partition up its territory after the fashion of Poland, among the States that have remained loyal to the Union." Our readers need not be told that the partition of Poland was the most infamous political crime recorded in modern history. Nor after all they have seen of the Yankee despotism, will they wonder that it has been chosen as a model worthy of imitation by the Yankee Secretary. We venture to suggest, however, that there is some slight difference between the relative positions of the parties in the two cases. Poland was not dismembered until the bloody battle of Praga, and the atrocious massacre that followed had prostrated her military strength. Amid the flames of her capital, and the slaughtered my triads of her children, her savage conqueror wrote to his scarcely less savage mistress, "order reigns in Warsaw." A Russian army of 100,000 men stood victorious in the midst of her people, a Prussian and an Austrian army, each of equal strength, were ready to lend their assistance if it were needed. But it was not, for her defenders were dead or in chains. It was an easy matter under such circumstances to divide her territory among those who had come to spoil her. Now, the Bull trotters, so far from having subdued the military strength of Virginia, dare not face her sons in the field. The Bull trotters partitioning Virginia! The Lord have mercy on us!

Promotion.

We understand that Colonel Maxcy Gregg, commanding 1st South Carolina Regiment, stationed in General Huger's department, has been promoted to the rank of a Brigadier General, and ordered to report to General Robert E. Lee, commanding Confederate forces in South Carolina. General Gregg proceeds at once to engage in the defence of his gallant State. His promotion is a well- merited tribute to his military capacity and a just reward of his distinguished services to the country. We predict for General Gregg a brilliant career if the enemy shall afford him an opportunity.

The Department of Missouri.

The late report in regard to the appointment of Col. Heth to the command of the Department of Missouri, to supersede General Price, created intense excitement in the West, which was happily allayed by the following dispatch from the President to an officer in Memphis:

Richmond, Dec. 9, 1861. To Major W. A. Broadwell:

The rumor that Gen. Price will be superseded is false, if not malignant. I have not received a tender of Missouri troops, and consequently have no power to make appointments for them, or to control their organization.

Jeff. Davis. The report now current is that Col. Het has been simply assigned to the Department of Arkansas and Missouri. Brigadier General Tilghmen.

This officer has been assigned to the command of the defences of the Cumberland and Tennessee rivers, on the line of Forts Donaldson and Henry. The headquarters are at Fort Donalson, near Dover, Tenn.

Death of prominent Unionists in St. Louis.

--Phocian K. McCreery, of the firm of Crow, McCreery & Co.; Benj. F. Crane, the well known jeweller; and William Bennett, of the firm of Russell & Bennett, died on Sunday, the 8th inst.

Army of the Potomac. [our own Correspondent.] Outposts, (Near Fairfax,) Dec. 8th, 1861.

Still everything is quiet on the outposts, and there are no signs of any advance on the part of the enemy. The weather continues fine, and the roads as good as they ever are either in summer or winter. No objections could now be offered for not fighting, on the score of had roads, for they are in excellent condition for the use of artillery and for the transportation of army stores. As there is nothing in the shape of war matters to employ my pen, I will give you the story of

Redmond Burke, the Scout,

who was captured by the Federals at the battle of Lewinsville, and recently escaped from their clutches by scaling the walls of the jail in Washington. While Gen. J. E. B. Stuart, then Col. Stuart of the 1st Virginia Cavalry, was in the army of the Shenandoah, he was joined by Burke and his two sons, all of whom enlisted in the cavalry; but the elder was retained as special escort and guide to Col. Stuart through the mountainous country of Northwestern Virginia.--After coming into the Army of the Potomac Burke was retained in the same capacity, and did some good service while our forces occupied Munson's hill. He was constantly in the saddle, and kept the Colonel, then in command of the outposts, well posted in regard to the movements of the enemy, and watched every advancing party with cat-like vigilance and stealthiness. Perfectly fearless, and yet possessing the requisite coolness for a successful scout, he soon became a great favorite with Col. Stuart, and when the latter was made a Brigadier, Burke was attached more closely to his person, and because his constant companion in the skirmishes with the enemy, at that time of almost daily occurrence.

Daring the battle of Lewinsville, on the 23th of September, Gen. Stuart sent Burke to make a reconnaissance in a small patch of wood near by, where some men had been seen, and ascertain whether or not they were the enemy. Being perfectly confident they were our men, Burke rode up to it without the proper precaution, and ran into an ambuscade, where some fifteen or twenty men lay hidden. They sprang up and pointed their guns at him; but still supposing them friends, he cried out, "Don't shoot me, I know you." They then gathered upon him, and burke, seeing it was no use to struggle against so many, gave himself up. At that moment a section of the second company of the Washington Artillery, under Captain T. L. Rosser, came into the fields and placed their guns in battery. Burke who had frequently seen the gallant Captain shoot, had no idea of risking his life by standing before his howitzers, and so begged to be taken to the rear. They took him back across the fields to a spot near Gilbert's house, and there he was met by the Colonel of the New York Seventy-ninth, who ordered him to dismount.

"That is a fine horse you have," said the Colonel.

"Yes," was the reply; "he is worth $20 more than on the day I got him."

"Where did you get him?"

"Down here in Prince William county," said Burke.

"What did you pay for him?"

"Nothing; I took him from your people at the battle of Bull Run--the saddle, too."

Burke showed them the mark, U. S., on the hoof, and also the name on the saddle. The Colonel was rather nonplussed, but took his horse and arms and sent him to Griffins battery. After the fight he was taken upon a caisson and carried to Gen. Smith's headquarters. Here he was closely questioned by an officer.

"Why did you come out to fight?" was asked him.

"For liberty," said Burke.

"I have come to the conclusion," said the officer, "'that you are fighting merely for the sake of fighting."

"I don't see how you could come to such a conclusion as that," said Burke.

"Well, what were you fighting for?"

"To repel the invaders from my State."

"Which is your State?"

"I am an Irishman by birth, but a Virginian by adoption."

The officer turned to his writing, giving an order to turn him over to the Provost Marshal, and a sentinel came in with a pair of handcuffs.

"Are you going to put those on me?" asked Burke.

"Yes."

"I thought we took all those from you at Bull Run. We never put them on the meanest of your privates, and I protest against having them put on me!"

The handcuffs were put on, notwithstanding the protest, and he was then confined in the guard-house. The next morning an officer took the handcuffs from him, and said they had been put on contrary to orders. The officer inquired particularly for Gen. Stuart, and said he had known him well in the old army.

In the morning Burke was taken to the Provost Marshal's office.

"Who are you?" said he.

"Redmond Burke, Aid to Col. Stuart."

"But a Colonel is not entitled to an Aid."

"I don't know what the rule may be in your army, but it may be in ours."

They would not believe the story, because Burke had a red flannel shirt on, and looked as rough as a ditcher.

"Where is your uniform?" asked the officer.

"We don't go in much for uniform," said Burke;" we don't fight for uniform either. Some of the highest officers in our army are dressed in citizens clothes.

While in the Provost marshal's office he sat by the window reading a newspaper. A crowd soon gathered around the house to see the rebel prisoner, and one fellow looked at him fiercely and said, "D — n you, I should like to shoot you." Burke replied that he had no doubt of it, but if they would give him a chance, he should have a fair fight, either on horseback or otherwise. Insulting remarks were made to him by the crowd until the officer in the room became ashamed of such treatment to a prisoner, and ordered the crowd dispersed. While at the headquarters of Gen. Smith he met a man by the named of Burns, orderly sergeant of General Stuart's old company of United States Dragoons, who made very particular inquiries about Stuart, and regretted he could not be with him again. Burns said he had recognized Gen. Stuart on the battle-field of the 21st, and that his love for him was so great that he could not fight well against him. If he had an opportunity he could not hurt a hair of his head.

The next morning Burke was taken before Gen. McClellan, who said he wished to have a little conversation with him. Burke replied that it would please him very much.

"I want to ask you a few questions," said Gen. McClellan, "and you can answer them or not as you please. There will be no compulsion about it."

"I am much obliged to you," said Burke, "I understand you to say I can talk as I please."

"Certainly."

The General continued his writing for a few minutes and then said:

"I desire to know what you want — what you are fighting for, and what you intend to do?"

The General

"I can only answer for myself," was the reply, and not for others. I am fighting for liberty and against despotism. We have our slaves and hold them as property. You say slavery is a curse — we think differently. We find the negro better off with the white man for a master, and the history of the world has proved it."

"I cannot understand how the negro can be more happy a slave than he could if free. You do not seem to appreciate the blessings of liberty. All men must be free and equal to insure happiness and prosperity to the country."

"I see new your feeling," said Burke, "you are trying to abolish slavery and you are

fighting us for this alone. You are trying to destroy an hereditary institution of the South and in the attempt you strike at the hearts of the people. You are mistaken."

"We do not desire to abolish the slavery, but only to prevent its extension. That should not make us enemies."

"But you have done more," said Burke "you have nullified the laws of Congress; in eleven States you have passed Personal Liberty bills; you have annulled the Dred Scott decision, and you have taken from the people the right of the habeas corpus."

"But the Constitution says that in the time of rebellion it may be suspended."

"I know it does, but it says, also, every man shall have a speedy trial by a jury; but you have refused it, the decision of the Supreme Court to the contrary notwithstanding."

Burke says that when he told him that no more questions were asked him, and in a short time he was sent back to jail. There he found a number of Confederates who had been captured before him. While there he was indebted for comforts to the Southern people in Washington. When he wanted any articles of clothing he told the keeper of the prison, who immediately got them in a store, requiring a receipt in payment, and the storekeeper knew where to get his money. The Washington ladies were very kind. At first they crowded the prison, but were soon stopped from coming. All the money on Southern banks was exchanged for them by the parson who visited them almost daily. One day the chaplain, who was a Southern man, told Burke that in Baltimore he had seen $500 in Confederate treasury notes exchanged for gold at only two per cent, discount. There were several Yankee prisoners in the jail and they were very envious of the attention paid the others. They spoke very highly of our army, and said everybody acknowledged that we had the best officers.

Finally an opportunity offered, and Burke, with the aid of his fellow-prisoners, scaled the wall, and made his escape. The fall lamed him somewhat, but with difficulty he managed to hobble beyond the sentinels, and took to the country. He was five days in passing the Yankee pickets, and had many very narrow escapes. The second day out, Burke became very hungry, and started towards a light which he saw in the distance, in order to get something to eat. As he approached the house he heard a man inside cursing the Yankees, and he at once knew that was the hotel for him. Sure enough, he met with a good reception, and was concealed until his foot recovered, when he was assisted on his journey. On arriving at the Potomac he happened to find a few plank that the high water had thrown upon the bank, and with the aid of these he swam to the opposite shore, and stood once more on Virginia soil. From the river Burke ran up to Shepherdstown, and arrived there just in the early evening. The news spread rapidly that he had returned, and his friends turned out to give him "a wake" at the hotel. By some means the Yankees were informed of his escape and arrival in the town, and sent over a party to capture him. Before they came Burke had gone out of the village, and was quartered with a friend, but in the night the house was surrounded by the Yankees, who loudly demanded his body. Hastily running up stairs in his night dress, he was assisted upon the roof of the house by a young lady, where he remained hidden until the enemy had left. The cowardly ruffians accused the young lady of assisting Burke to escape, and one of them struck her in the face with his fist, knocking her down, and injuring her severely. The people of Shepherdstown insisted strongly upon his remaining a day or two, but he refused, and hurried on to report to Gen. Stuart. He was received here with much pleasure, and he now has a seat at the General's table, and is once more engaged in the daring exploits incident to the life of a scout.

One little incident is worthy of record. The day before the fight, Capt. Manning, Aid to Gen. Longstreet, gave Burke his spur to put a new rowel in. The spur was carried in his pocket through his captivity, and the first thing he did on arriving in Martinsburg was to put a new rowel in it, and, on arriving here, the spur was duly returned to its owner.

Burke is now a great favorite among the officers on the outposts, and is doing his country good service in keeping the Generals well posted in all movements of the enemy. He is one of the characters in this war that will live in history, and will furnish material for numerous tales and romances when the war is over and peace restored to the Confederate States. The House met at Prayer by Rev. W. W. Bennett.

Mr. Barbour, of Culpeper, offered a resolution, which was adopted, that the Committee of Finance be instructed to tender relief to the suffers by the conflagration in Charleston.

The bill on the extortion in the article of salt was ordered on its second reading.

On motion, it was

Resolved, That cities and towns be reimbursed (from the State Treasury) for equipping volunteers.

The following resolution, offered by Mr. Payne, was adopted:

Resolved, That the Committee on Courts of Justice be instructed to inquire into the expediency of so amending the usury laws of this State that, in contracts hereafter entered into for the lending of money, the borrower may obligate himself so pay such taxes as the State of Virginia may levy on said money.

Mr. Baskerville offered a resolution to continue in force the present stay law sixty instead of thirty days from the meeting of the General Assembly, which was laid on the table.

Mr. Steger offered a resolution, which was adopted, that the Committee on the Courts of Justice be instructed to inquire into the expediency of reporting an ordinance providing for the speedy collection of rents.

On motion of Mr. Blus, the House adjourned.

Senate.

Small notes.

On motion of Mr. Christian, of Augusta,

Resolved, That the Committee on Banks inquire into the expediency of issuing treasury notes of a denomination less that five dollars, and receivable in payment of taxes, to supply the necessity for a sound small note currency.

Negro convicts.

On motion of Mr. Johnson,

Resolved, That the Committee on Finance and Claims inquire into the expediency of paying to E. J. Backeralter and W. H. Pate, jailors of Bedford, the amount of their respective claims for imprisoning and keeping certain negro convicts hired on public works, who escaped and were apprehended as runaways and confined in the Bedford jail.

The Charleston sufferers.

Mr. Thompson of Dinwiddie offered the following resolutions, which were adopted:

"Resolved, That the Senate tender their sincere sympathy to the suffering citizens of Charleston in the distressing circumstances to which they are reduced by the recent conflagration which has visited that city; and recognizing them as our brethren, identified with us in interest, united in a common destiny, and engaged in a common cause alike dear to us all--

"Resolved, That the Committee of Finance be instructed to inquire into the expediency of an appropriation for their relief.

Senatorial vacancies.

Mr. Thomas, of Fairfax, from the Committee on Privileges and Elections, reported a bill to provide for holding elections to fill vacancies in the Senate from the 46th and 50th districts.

On motion of Mr. Thompson, the Senate adjourned.

Fatal Railroad accident.

--Last Friday a gravel train, on the Memphis and Charleston railroad, ran off the track near Dixon, Alabama. By this accident the fireman, a man named Carpenter, was killed, and severe injuries were sustained by the engineer. This accident occasioned the detention of the passenger train due in this city Saturday at .

A balloon was observed about on the morning of the 13th inst., in a southerly direction from Charleston, S. C., showing a bright blue and red light.

Local matters. The law and the Fare Banks.

--For nearly three days last week the Hustings Court of the city of Richmond was occupied with the trial of John A. Worsham, presented by the Grand Jury for permitting "a game commonly called faro bank" to be exhibited on his premises. The Court and jury listened with becoming patience to the examination of witnesses, and the case was elaborately argued by the learned counsel on both sides. At a late hour on Saturday the jury retired to consult, but found it impossible to agree upon a verdict — were discharged — and the case was continued to the next term of the Court, the defendant giving bail for his appearance. Altogether, this legal demonstration against the faro banks of this city, initiated by the Mayor and the police, some weeks ago, has turned out to be a complete farce.--We have no means of ascertaining the precise number of these institutions in Richmond, but will assume that there are a hundred. There may be more, or there may be less. Two or three are entered by the police, some contraband articles seized, and legal proceedings are commenced against a few men of the gambling fraternity. One unfortunate "sport," who happened to be caught in the act, being minus the means of enlisting the efforts of able lawyers in his behalf, has been sent to jail for twelve months, and two or three well-known citizens have forked over a small fine which the law imposes upon amateur gamesters; but the leading cases still "hang fire" in the Courts, and nobody has been benefited except a few legal gentlemen, an exception which we do not regret. The game goes on, for aught we know to the contrary, with as much vigor and profit as ever. The moral atmosphere still reeks with the taint of "gambling hells," and the metropolis of the South makes no advance towards that condition of blissful purity so confidently predicted after the occurrences of that eventful Saturday . We think the gamblers hold all the trumps and all the honors, and the municipal authorities might as well give up the game.

Still Seceding.

--The Grand Division of the Sons of Temperance of North Carolina, at its recent meeting, adopted an able report, announcing its withdrawal from the jurisdiction of the National Division of North America, and declaring a purpose to co-operate with others in the formation of a National Division in the South. We deem it due to the jurisdictions in the Confederate States to say that they have had nothing to do with the old organization (embracing the Northern States) since the fall of 1860. Since that period, all necessary action of a national character has been performed under the direction of our townsman, Col. Thomas J. Evans, who was the highest active officer in the Southern Confederacy when the separation took place. We ask attention to a call for a meeting of the Grand Division in this city, on the 8th of January next, when we hope the attendance will be numerous, and such steps be taken as will bring about a speedy and permanent organization for the Southern States.

Another bloody deed.

--On Saturday two soldiers belonging to the 4th Louisiana Battalion were passing in company along

, when, from some cause at present unknown, one of them thrust a knife into the other's breast, inflicting a severe wound. The injured man, whose name is John Dowdy, was conveyed to one of the hospitals in the vicinity; and information of the occurrence having been communicated to Capt. Gibbes, of the Government prisons, he caused the arrest of the soldier who committed the deed, and he was handed over to Officers Seal and Perdue, of the city police. He gave his name as Zach. Burnett. It was reported yesterday morning that Dowdy was dead, but on inquiry last evening we learned that he was in an improving condition. The case will probably undergo investigation to-day at the Mayor's Court.

Home defence.

--A meeting of citizens was held at the City Hall on Saturday to make arrangements for the organization of a battalion to serve in the batteries near home, in accordance with a notice published in the papers of that day. Col. Wyndham Robertson presided. The object of the meeting was explained by Wm. P. Burwell, Esq., and a committee was appointed to propose a plan for future action, and report to an adjourned meeting on Tuesday . A satisfactory account of the state of feeling on the South side of the river was given by Col. Burfoot, of Manchester. An appeal was made to the citizens by A. A. Hughes, Esq., who, we learn, is authorized to recruit a company for home service. We hope the meeting on Tuesday will be largely attended.

The stabbing affair.

--Daniel Workman and Cornelius Collins, who were arrested on Friday upon a charge of stabbing Daniel Sullivan, were arraigned before the Mayor on Saturday. Captain Wilkinson stated that Sullivan pointed out Workman at the station house as the man who stabbed him, but no other evidence was then in court. Sullivan had been carried to the poor-house hospital, and it was stated that his injuries were not dangerous. Workman remarked to the Mayor that he did the stabbing; that Sullivan struck him several times and refused to desist, when he took a small knife from his pocket and cut him. The Mayor discharged Collins from custody and remanded the other for further examination to-day.

Fire.

--At an early hour on Saturday , a building formerly occupied by F. G. Ruffin as a guano mill, but lately as a snuff and tobacco factory by Charles L. Hobson, on

Cary street
, north side of the Basin, took fire and was partially destroyed. The property belongs to the estate of Mr. S. D. Crenshaw. By the well directed efforts of the firemen the damage was principally confined to the roof and upper story, though the machinery and stock sustained a good deal of injury from the flood of water. The building, which is insured for $10,000 in the Insurance Company of the State of Virginia, is damaged to the amount of about $2,000. We understand that the machinery was insured for $13,000, in the Merchants', Valley, and Alexandria companies. The origin of the fire is unknown.

Arrests.

--The watchmen made several arrests on Saturday , among them the following: Wm. Leftwich, charged with shooting at Peter Padraette, with intent to kill, and attempting to shoot Simon Coffee; Michael O'Brien, drunk and disorderly, and "breaking the house" of Simon Coffee; and Michael Kennedy and James Broderick, charged with fighting in the street. A boy named Joseph Keller was arrested yesterday for committing a burglary at Dove's drug store. The Mayor will have a pretty large docket this morning.

The Insurance companies.

--We have not been able to ascertain the precise extent to which the Richmond Insurance Companies are interested in the Charleston conflagration.--While some of them doubtless have pretty heavy stakes involved, we have no apprehension that there will be a failure to meet the liabilities promptly. The Old Dominion Company have received information that their loss will not exceed $5,000; and we hear, from undoubted authority, that the Valley and State of Virginia agencies will not lose more than $20,000.

The Zouaves.

--The accomplished performers at Franklin Hall have been induced to prolong their engagement, and will appear this week in some new and gorgeous spectacles, including a grand military pageant, pantomimes and farces, comic operas, &c. We have heretofore spoken favorably of the artistic talent of this company, and later observations justify us in reiterating the opinion. The French colloquy, to our mind, is no objection; for, while it is in itself musical, the expressive gestures and movements of the performers afford a sufficient translation of its meaning.

The Zouaves will give a grand performance on Wednesday , for the benefit of the Charleston sufferers.

Released

--Frank Tormey, a young Baltimorean, who has been held in custody for a few weeks past on suspicion of complicity in the financial exploits of "Colonel" William N. Miller. was released on Saturday by order of the Hustings Court. It was his unlucky fate to become mixed up in the affair by accident, and to go through the disagreeable course to which any one is liable who happens to fall into bad company.

Another arrival.

--Another small lot of prisoners of war arrived on Saturday by the Fredericksburg train. Five of them were captured on the Potomac while pleasant sail in a boat, the particulars of which are elsewhere given, and the remaining three are civilians, charged with disloyalty.

Fined.

--The Mayor on Saturday imposed a fine of $5 upon William B. Franklin, for slapping. And shortly in the face with a piece of corn beef. This peculiar assault was occasioned by a suspicion on his part that Mrs. Shortly had been stealing from his stall.

Fulling from Grace.

--At a late hour on Friday , a watchman, making his rounds in the upper part of the city, discovered a man laid out in a state of inebriety under the porch of a dwelling, and having roused him from his slumbers, conducted him to the station house. He was dressed in Federal uniform, and gave his name as Charles VonGelsa. An entry was accordingly made upon the record, of "drunk and asleep under a porch, and from Lincoln. " On his examination before the Mayor on Saturday he produced the following letter, the signature to which we omit:

"St. Mary's co., Md., Nov. 10, 1861.

"Mr. Charles Von Gelsa, the bearer of this, is a deserter from the Northern Army. He held the office of Second Lieutenant in Sickles' Brigade. He can prove this if necessary. Please try to get him an office."

It appeared that Von Gelsa was brought to Richmond as a prisoner of war, but with such undoubted recommendations of his integrity of purpose as to enlist the opinion of the authorities decidedly in his favor. He represents that he is a son of Baron Von Gelsa, a General in the Prussian Army, and it further appears that he was with Gen. Sidney Johnston in the famous Utah campaign. Desirous of again serving under his old commander, an arrangement was made by Gen. Winder to send him to Kentucky, and on Friday he was released on parole; but the allurements of the great metropolis led him into temptation, and a big spree was the immediate consequence. The Mayor said he would make the necessary inquiries touching his case, and we learn that he was afterwards transferred to the custody of the military commander of this post.

Concerts this Week.

--Our readers have already been apprised of the concerts to be given. This week for the laudable purpose of relieving the necessities of the soldiers and those they left behind them. The first takes place to-morrow night, at the United Presbyterian Church, and the proceeds are to be given to the families of our Richmond volunteers.--We are informed that several ladies and gentlemen of the city, not ambitious of professional renown, but nevertheless highly accomplished in the musical art, have volunteered to appear in public on this occasion, and we may therefore anticipate a most entertaining performance. A still greater incentive is found in the object of the concert, and we very much mistake the spirit of our people if they shall fail to make a generous response to the appeal. The second performance, for the benefit of the Maryland volunteers, occurs on Thursday .

Discharged prisoners.

--Among the prisoners brought to Richmond at various times since the commencement of hostilities, are a considerable number of Lincolnites, who have vegetated on the soil of Virginia and made themselves infamous by affording aid and comfort to the enemy. The recent investigations have sustained the allegations in many instances, but the Government has ordered the release of twenty-three, who are now at liberty to return to their homes, if they have any, or join the Southern army, as they may severally elect.

Free negroes.

--The Hustings Court has ordered that all free negroes in the city who fail to pay their taxes before the meeting of the January Court, shall be sold into slavery.--Doubtless many of them would be improved by this change of status; but those who wish to avoid it must call at the Captain's office and settle.

On Saturday last the "black flag" was hoisted over the depot of the Virginia and Tennessee Railroad Company, at Lynchburg.

--I am requested by my company to present to you, through Sergeant S. B. Hughes, a service of silver, as a slight testimonial of their regard for you as a man, and in consideration of your kind and skillful attention to them as a physician, whilst they were encamped near you. They will ever remember you with gratitude, and by these mementoes they wish to be remembered by you. Allow me to add my own thanks for your kindness to my men, and my best wishes for the prosperity of yourself and family.

When I offered to your company, during their encampment near my house, my professional services, it was without the prospect of reward, except the conscientious approval of my own breast, of doing what I conceived to be my duty; and, to avail myself the first opportunity, as a citizen of York county, to contribute to the 2nd Co. of Howitzers, my humble share towards liquidating the debt of gratitude, which we feel we owed to them, for the gallant manner in which they defended our homes from the invasion of a common enemy. The cordial manner with which I was always greeted by your men, and the expressions of gratitude which they invariably offered on every visit to them, both day and night, were to me evidence of the fact, that my services were kindly received and appreciated by them, and went far to lighten the duties and anxieties incident to an arduous professional life. It is my earnest wish and prayer, that the same kind Providence, who so signally watched over and protected them in the day of battle, will continue to throw around them the guardian arm of protection, and when this unnatural and unholy strife shall cease, may they be permitted to return in the enjoyment of health to their homes, and to their friends, and receive from their country that grateful meed of praise to which their services so justly entitle them.

Cause and Contrast: An Essay on the American Crisis of 1861. By T. W. MacMahon.

The Publishers feel constrained to offer a word of apology and explanation to the public relative to the delay in the publication of this work. When first put to press, but 2,500 copies of it were ordered to be printed; the demand for it caused the order to be increased to 5,000; and now, before the close of this week, there will be 10,000 copies of it in the market — illustrating this gratifying fact, that the South is willing and capable to encourage and maintain a literature of its own.

From our latest Southern exchanges we make up the following summary of news:

Arrest of non, Edward Stanley, of North Carolina, and his nephew.

We regret to hear, says the Lynchburg Republican of Saturday, that information has been received, via Manassas, that the Hon. Edward Stanley and his nephew, Capt. Fablus Stanley, U. S. N., have been arrested at San Francisco and lodged in jail. These gentlemen are natives of North Carolina, and it was suspected by the miserable Lincoln despotism that they were about to return to the States for the purpose of resuming their residence in the South. The Hon. Edward Stanley represented one of the North Carolina Districts in the Federal Congress for many years.

A regiment of Choctaw Indians tendered Gen. Floyd.

The following correspondence, which we copy from the Rockingham Register, of the 12th inst., explains itself. Of course the War Department will accept the offer of the services of this regiment of warriors, who are the very boys to assist in chasing the Yankees from the sacred soil of this proud old Commonwealth. The regiment was raised mainly through the agency of Col. George E. Deneale, of Rockingham, Va., who spent six weeks in the Choctaw nation, haranguing the people until their blood was fired:

Doaksvill, (Capitol of the Choctaw Nation,) October 11th, 1861. Brigadier General J. B. Floyd--Dear Sir:

Having been informed by Col. Deneale that you are ready and willing to receive one or more companies of Choctaws as a part of your brigade in the Confederate service, it is with pride and patriotic pleasure that I tender to you, through him, the services of my command of Choctaw warriors to vindicate our common flag, and to aid in driving the Northern vandals from our sacred and consecrated soil.

In tendering this command to the Confederate States, I am only imitating the glorious character of my warrior father, Pushinatahaw, who now sleeps upon the once honored soil of the South, but now lies beneath the iron heel of the despot, Abraham Lincoln. By patriots he was entombed in Washington city--by patriotic legions I hope to regain his ashes.

My command shall be ready for active service and ready to march by the 1st of December next. And I further request that orders may be sent by you through Col. Deneale to convey us to the field of battle, which we will make the field of glory, or fall in the attempt.

Yours, affectionately, Johnson Pushmatahaw. Headquarters on the Kanawha, Cantonement Verina, Nov. 27, 1861. Col. Geo. E. Dencale--Dear Sir:

Your note relative to the Indian Regiment, received this morning, was extremely welcome to me I will gladly accept the services of these warriors if the War Department consent; and for this I have written to-day. I have urged the measure upon the Secretary, and hope for a favorable reply. I will inform you of it at once.

In the meantime please-write and express my high appreciation of the offer to the gallant Chief Pushmatahaw. And by the way, my father was a friend of the old Chief; and being a member of Congress when Pushmatahaw died, was often to see him in his illness, and officiated in some measure at his funeral. I should like to stand by the side of his funeral I should like to stand by the side of his son on the battle-field in this struggle for liberty.

From a letter in the Lynchburg Republican dated "Army of the Valley, Winchester, Va., Dec. 9," we extract the following:

There has been some skirmishing down on the Potomac below Martinsburg this last week. On last Thursday Gen. Jackson ordered four pieces of Pendleton's battery and four companies of infantry to Martinsburg, for the purpose of destroying Dam No. 5 on the Chesapeake and Ohio Canal, which would very much incommode the Federals; and on Saturday the battery took their position on the bank of the river to demolish the Dam, but the enemy opened fire upon them, when they were obliged to recross the river; our battery then opened fire upon the enemy, attempting to drive them from their position, and continued to fire until dark, when they ceased for the night, but commenced firing again soon the next morning, and continued until about , when they withdrew from their position and returned to Martinsburg. The enemy had no cannon, but their men were armed with the Minnie and Enfield Rifles. We lost one man killed, belonging to Col. Ashby's regiment, and had one wounded; the other which was only a slight wound, belonged to the battery.

This dam will probably again be attacked in a few days and destroyed, even if our men have to cross the river.

There was another small force ordered from here last night towards the river, consisting of four companies of the 27th regiment and the two remaining rifle pieces of Pendleton's battery. The Yankees are now six miles this side of Romney, and abodt six or seven thousand strong.

From Tybee and Green Islands.

We take the following from the Savannah News, of the 12th inst.:

The six Federal vessels at Tybee, reported yesterday, remained in the same position all day Tuesday and Wednesday. They seem to be doing nothing. Yesterday morning a squad of about forty, headed by an officer, visited Mr. King's place, when a shell from the Fort scattered them. At , another party, of about the same number, went over again, when another shell made them take to their heels. The Federals appear shy, and do not venture far from the protection of their ships. Their movements are observed, and it is thought something will turn up before long.

We learn that yesterday afternoon two Federal gunboats attempted to pass through Hurlgate inlet, about two and a half miles from our batteries on Green Island. Four shots were fired at them from a rifled cannon at Fort Sereven, when the vessels very prudently retired.

The defence of Galveston — the Island Untenable.

We find in the Houston (Texas) Telegraph, of the 2d instant, the following addenda to an editorial on the defences of Galveston:

A council of war was held at Galveston on Wednesday last, the result of which has not definitely transpired. It is rumored, however, that the conclusion arrived at is that Galveston is untenable. In support of this rumor, the batteries on the beach have been removed; the powder and other munitions of war on the island have been taken to a place of greater security; a portion of the public records have been removed; and a building has been rented in this city to be used as a hospital, to which the sick in the Galveston hospital have been removed. So much for the action of the public authorities.

Richmond Dispatch. Monday morning...Dec. 16, 1861. A Confederate victory in Western Virginia--a severe fight — the enemy Rented.

The monotony that had prevailed for some says past was broken on Saturday by the receipt of official intelligence that the enemy, stationed on Cheat Mountain, had sallied out and attacked a small force of our troops, and were repulsed with heavy loss. The fight took place on Friday last, the 13th instant, on the Alleghany Mountain, fifteen miles west of Monterey, to which point the force remaining in that vicinity, under Col. Edward Johnston, had Fallen back and encamped.--The official dispatch received on Saturday says that the battle commenced at , in the morning, and lasted until , in the afternoon, when the enemy retreated; that the Federals numbered 5,000, while Col. Johnston's command was only 1,200 strong, but has since been reinforced by two regiments.

We have private information which mainly coincides with the foregoing. Our camp, it is stated, was surprised by the enemy at in early hour in the morning, but the troops allied gallantly to their work, and fought with the energy of desperation. The troops under Col. Johnston's command were portions of the 12th Georgia and the 31st Virginia regiments, Col. Baldwin's Virginia regiment, and Hansbrough's and Regar's battalions — in all, probably not much over 1,200 men. From statements gathered from two prisoners captured a few days previously, it is presumed that the enemy's force was from 1,000 to 5,000. Our loss in the battle is set down at 25 killed and 75 wounded and missing. Among the killed are the following:

Capt. B. P. Anderson, of the Lee battery, from Lynchburg, a gallant and meritorious officer.

Lieut. Lewis S. Thompson, of the Marion Guards, a son of Judge Thompson, of Wheeling.

Among the wounded are Lieut. Col. Hansbrough, Capt. Deithier, one of Col. Johnson's aids; and Capt. Mollohon, of the axton county company.

The 31st Virginia regiment, commanded by Major Boykin; suffered more severely than my other. This is the regiment formerly under Col. Wm. L. Jackson, who was superseded by Col. Reynolds and resigned, but was reappointed to the command of the regiment on Saturday last. Col. Jackson is now a Richmond.

The enemy left eighty dead on the field, said their loss in killed and wounded is believed to be very heavy. It was a desperate fight, and a dearly bought victory.

Col. Edward Johnston, under whose command the battle was fought, is a native of Chesterfield county, Va. He was an officer in the old U. S. army, and distinguished himself in Mexico. After his resignation, he returned to Virginia, and was assigned to the command of the 12th Georgia regiment, in Loring's division, a portion of which had been lately transferred to another point leaving Col. Johnston the senior officer of the post. This force, at Camp Alleghany, expected orders to move eastward, when the enemy came out from the stronghold on Cheat Mountain and made the attack, anticipating an easy victory, but returned discompared and beaten.

We are indebted to gentlemen from Western Virginia for the foregoing particulars.

Important from Washington — an early advance Contemplated.

Important information direct from Washington reached the Government in this city Saturday , which will not be permitted to transpire. It was confidently asserted when the informant left Washington, last Wednesday, that an attack from the Potomac would be made within ten days; and appearances seemed to indicate that such was the intention. All the troops destined for the enterprise were said to be already on this side of the river.

Prussian officers in the Confederate service.

The Northern Abolition prints have endeavored to make a great Point of the zeal with which European officers have enlisted in their unholy cause, but appearances do not indicate that the vast results anticipated will be realized. Like their big balloons and other militated humbugs, it has furnished material for heavy newspaper bragging, but has not yet contributed in the smallest degree towards the subjugation of the "rebels." Indeed, we know that two Prussian officers have deserted, one from Sickles's brigade, and one from the 45th New York regiment, and are now on their way to join the command of Gen. A. Sidney Johnston, in Kentucky.--The Baron Von Flazthausen, who has been in the city for some days past, produced satisfactory evidences of his origin, history, and integrity of purpose; and though as in all similar cases, a military investigation was necessary before receiving him into our service, we have no doubt, that he reflects the sentiments and wishes of many Europeans, who, through necessity or some other cause have been induced to take up arms in behalf of the Northern despotism. The second case is that of Charles Von Gelsa, who also departed yesterday for Gen. Johnston's division. It is nonsense to say that a recently imported European will fight for the North through any devotion to the flag. They may be influenced by other motives, but the more honest among them will abandon the purpose when they become convinced, as some have been already, that the cause of the South is the cause of civil and religious freedom.

Firing on the Potomac.

On Thursday last, a Federal steamer, supposed to be the old Mount Verson, which has been razed, anchored off Boyd's Hole, below Pratt's Point, on the Potomac, as supposed for the purpose of reconnoitering. Capt. Cook, finding that she was only about two miles distant from his battery, concluded to have a little artillery practice, and accordingly-opened fire on her about . He fired some fifteen or twenty rounds, and, as near as could be ascertained struck the steamer three times. She responded feebly and without effect, her projectiles failing to reach the shore.--Some of the shots from the battery ricocheted most beautifully, and landed on the Maryland side, full three miles distant. The steamer, finding the locality somewhat dangerous, drew off as hastily as possible, and vented her spite by shelling an old vacant house some distance below, but did no damage whatever. Two Federal steamers came down the river the same day, directly after the firing, and anchored off the Maryland shore opposite Pratt's Point. One of them took seven companies on board and returned up the river and the other remained there at last accounts. These facts we learn from a gentleman who witnessed the cannonade. There was firing from the Evansport batteries on two or three occasions last week. We regret to learn that three soldiers were injured by the bursting of a gun at that point on Monday.

Exchange of prisoners.

The report that the Hon. Charles J. Faulkner had been released from his imprisonment at Fort Warren, on parole, preparatory to his exchange for Congressman Ely, is confirmed. A Washington telegram of the 5th instant, says that Mr. F. "will proceed immediately South, and procure a similar release of Mr. Ely. If not successful in that errand, he has pledged himself to return to custody in thirty days." We also learn that the gallant Captain DeLagnel has been exchanged for the Federal Captain Ricketts, who was wounded in the battle of Manassas and taken prisoner.

Gen. McCulloch.

Gen. Ben. McCulloch, of Texas, arrived in Richmond on Saturday last.

The Test Oath Ordinance was most signally defeated in the North Carolina Convention on the 10th inst.

Great fire in Charleston.terrible loss of property.Great Distress and Suffering.list of property destroyed.&c., &c., &c.

The fearful conflagration that has just passed over the city of Charleston will cause the 11th and 12th of December, 1861, hereafter to be remembered as one of those dark and trying periods which for the moment seem to paralyze all their long-cherished hopes and bright anticipations of the future. We have received Charleston papers of the 13th inst., bringing full particulars of the great fire in that city — the loss of property, list of sufferings, &c. The elaborate telegraphic report which appeared in our columns on Friday last gave an account of the progress of the fire up to , Thursday. The Charleston Mercury, of the 13th inst., (Friday,) furnishes us with the following additional particulars:

"Yesterday was a gloomy day for Charleston. Business was universally suspended, and, with one impulse, our community united in giving sympathy and aid to the victims of the great public calamity.

Our report, in our last issue, of the progress of the fire closed at quarter past on yesterday, when the majestic spire of the Cathedral had just tottered and crashed heavily through the burning roof. From that time the disaster may be said to have assumed a new phase. The flames leaped madly across

Broad street
, and, forsaking the business neighborhoods which they had already desolated, they seemed to devote their whole fury against the elegant private residences which have so long been the pride of the southwestern portion of our city. As these beautiful homesteads succumbed, one after another, to the resistless march of the destroying element, the scene was awful.

The fire advanced steadily onward, stopping only, when having reached the river, it had nothing more to burn. We give some notes of the disastrous results:

The Cathedral of St. Finbar.

This splendid structure, built only about eight years ago, was justly rated one of the finest architectural ornaments of our city.--It was constructed of brown stone, in a very massive and costly manner. All the sacred vessels were saved. The Bishop's residence, attached to the Cathedral, contained a rare and valuable library, a portion of which was saved.

The Circular Church.

The site recently occupied by the Circular Church was formerly, in the memory of many of our old citizens, the lotus in quo of a brick church, known as the "White Meeting." It had its origin coevally with the settlement of the city in 1680. The congregation was originally Presbyterian, but probably united both Congregationalists and Presbyterians. In 1734 the latter separated and commenced worship in a new wooden edifice, on the site of the present "Scotch Church." The pulpit has been filled for a period of 175 years, by seventeen pastors, commencing with the Rev. Messrs. Pierpont, Adams, and Cotton, in the latter fifteen years of the 17th century, and followed by the Rev. Stobo, Livingston, Bassett, Parker, Smith, Edmonds, Hutson, Bennett, Thomas, Tenent, Hollingshead, Keith, Palmer, and Post.

On the 25th May, 1806. the new building was opened for the first time, with appropriate religious exercises. The new building was circular in form, and 88 feet in diameter. In 1838 the addition of a lofty spire, 182 feet high, added to the appearance of the building.

A few years since, the Church was entirely renovated, at an expense of $20,000, rendering it one of the most beautiful and consistently arranged of our city places of worship. The numerous tablets were re set — the old fashioned pulpit gave place to the more appropriate rostrum — the pews were re-arranged, and the manner of lighting the entire building, from the centre of the dome, secured a soft and equally diffused light. The building is a total loss.

The Cumberland Street (Methodist) Church.

This was a plain, substantial structure, affording commodious apartments for their large congregation, with galleries and basement rooms for a very large slave membership. It was swept away in the great fire of 1838, and rebuilt soon after. It is again entirely destroyed.

St. Peter's (Episcopal) Church.

This building was located on

— was a neat and well arranged edifice, with ground floor and galleries. The congregation is quite a full one, and it has been for some time past under the rectorship of the Rev. Mr. Prentiss. It is entirely destroyed.

The friends' Meeting House.

The St. Andrew's Hall.

This well known and historic building, in which the Convention of the People of South Carolina held its sittings and agreed upon the Ordinance of Secession, on the 20th of December of last year, is now in ruins. The walls are standing, but the interior is entirely consumed. We learn that the splendid full-length portrait of Queen Victoria, by an eminent artist, which has always been considered one of the attractions of the room, as well as the portraits of Tunno, Robertson, King, and others, were removed in time.

Institute Hall.

This magnificent hall, the largest in the South, is lost to us, and we feel sure that it will be seriously missed — connected as it was with the popular heart by the fact that within its walls the first uprisings of the people of Charleston in this revolution had utterance; and, more than all, because the Ordinance of Secession was ratified there. Those who, but a short year ago, were witnesses of those soul stirring scenes which ended in secession, will deeply regret the demolition of the Institute.

The Express building.

The office of the Southern Express Company was burned to the ground, and a large quantity of miscellaneous goods was lost. The Express office will, we learn, be re-opened in

The Savings' Bank.

This institution is a sufferer to the extent of its convenient office; all the papers, books of accounts, records, &c., were saved. We regret to hear that the Treasurer, Henry S. Griggs, Esq., who resided on the premises, lost all of his household furniture, and a portion of a very valuable collection of paintings, which he had been collecting for some years.

The Apprentices' Library.

Is, we learn, a total loss. To no one will this be more distressing, than to the octogenarian gentleman, Dr. Jos. Johnson, under whose care the Society has been for so many years. In addition to this, the Doctor is, we believe, himself a sufferer by the conflagration.

Cameron & Co.'s "PhŒNix iron Works."

This extensive foundry and machine shops is again in ashes, being the second time in the last ten years that its energetic and popular proprietors has been visited with fire. The entire premises are in ruins, including large quantities of shot, shell, and other ordnance stores, ready for delivery to the Confederate Government, amongst which were valuable and improved machinery for rifling cannon, making percussion caps, &c. The powerful steam fire engine which was prominently at work during the conflagration at different points, was built at this establishment. We sincerely trust that our stalwart friend and his co-workers will soon, phœnix-like, arise from their ashes, and overcoming all obstacles, furnish another illustration of their ability to meet the most disheartening reverses with manly fortitude.

Incidents.

Capt. Steedman Yeadon did yeoman's service at the fire as engineer. He handled the powder with marked success, and in almost every instance where the operation of blowing up houses was performed, the most complete success was the result. In this hazardous work he was assisted by Capt. J. E. Bowers, who was injured, we regret to say, about midnight, and was taken home by his friends. We trust he is but slightly injured.

One of the most gratifying incidents of the fire of Wednesday , was the zeal manifested by our slaves, in their efforts, as firemen and laborers. The entire colored population, male and female, worked most earnestly; and not unfrequently, masters and their slaves could be seen working together in removing the household goods and valuables. We noticed one instance particularly, where a white-haired old body servant was giving way to his feelings — sobbing bitterly — at the loss of the "family mansion, where we been libbin all our lives."

The Mills House most fortunately escaped with little damage.

The Courier, of Friday, the 13th inst., gives the following particulars:

We have been visited by one of those mysterious dispensations of Providence which we cannot attempt to solve. Our city has received a terrible blow, which it will take the work of years to repair. Let us nerve ourselves then for another start, thankful that we are still left with the same bold spirit and strong arms to make new, and perhaps more substantial, prosperity for our beloved city.

As was apprehended at the time of closing our brief report Wednesday , the flames continued to increase in virulence and with the scarcity of water seemed to defy all human efforts to arrest them. Keeping on in a south westerly course, the roaring element rushed through almost like forked lightning, and commenced a work of destruction on

and
King streets
truly terrible. Roof after roof fell in; the fire rushed out of the windows and lapped round the buildings, presenting an awfully sublime appearance.

All of a sudden it was announced that beautiful architectural structure, St. John's and St. Finbar's Cathedral, was in flames.--The pride of that portion of our city was doomed to destruction, and its beautiful spire soon fell with a terrific crash, sounding high above the noise of the devouring flames.

streets, and including that time-honored structure in
Broad street
, St. Andrew's Hall, which, in a short time, had nothing standing but the bare walls. The flames spread right and left, destroying and making a clean sweep of fine residences in Logan, New, Savage, Mazyck, and the lower end of Broad streets. Nor could the work of destruction and desolation be stayed had it not been that the fire exhausted itself for want of material.

Having crossed the city from the Cooper to the Ashley, the flames seemed to make one last desperate struggle for existence in enveloping the large mansion of Mr. Wizard Bull at the foot of

, and then yielded to its fate, sending its dying hisses, as though scorning the powers that so gallantly resisted his progress.

The loss of property has been variously estimated at from five to seven millions of dollars.

We have endeavored to obtain a correct list of houses consumed, with the name of the owner and occupant. First, we will commence with the place where it was first discovered, issuing from the sash and blind manufactory of W. P. Russell & Co., foot of

Hasell street
, North side.

Mr. Russell thinks it the work of an incendiary. The establishment had been closed, and the furnace of the boiler covered with water before the men left. The proprietor did not leave for an hour and a half or more after the workmen. When he left everything was in order, and no sign of fire or anything approaching to it. In about an hour and a half afterwards Mr. Russell heard the alarm of fire, and learned that his establishment was on fire. From these circumstances he infers that the fire was set, or was the result of carelessness on the part of a number of country negroes who had been quartered under an old shed adjoining the establishment, in allowing their camp fire to get ahead of them.

The building and stock of Russell & Co. were valued at $20,000--insured for $10,000 in Charleston. The insurance is equally distributed between the Charleston companies.

Messrs. Cameron & Co.'s loss is a severe one. The establishment embraced some eight buildings, namely, an office, an erecting shop, machine and fitting shop, a foundry and blacksmith shop, two boiler shops, a pattern store room and natron room. The stock of material on hand for the establishment, and for Government purposes, was not less than $200,000. We have not learned what insurance there was upon the stock or buildings.

At the time of conflagration there was 300,000 pounds of Sea Island cotton in the seed, worth about $15,000, and belonging to Edisto and John's Island planters. No insurance on the cotton. . Telegraphic news. From Columbus and Cairo. Memphis, Dec. 13.

--Great commotion prevailed at Columbus yesterday.

Mora troops have been sent to Gen. Bowen, at Feliciana; also a regiment to Union City.

The Federals at Calve have changed their policy. No one is now allowed to leave there, and all communication has ceased.

The Government transports remain idle in the day time, but are busy at night.

It is supposed in high official quarters that the Federals are moving in immense force up the Tennessee river, in order to cut off communication with Bowling Green.

Federal Outrages — news from General Thompson. Memphis, Dec. 14.

--Three thousand Federals at Paducah marched to Vienna on Thursday, and burnt dwellings, timber piles, &c.--They returned to Paducah, but made no attack on Fort Beauregard.

All is quiet at Columbus, Ky.

Jeff. Thompson recently surrounded a party of Federals who were guarding the bridge between Charleston and Bird's Point, and killed four and captured two of the bridge guard.

Federal Telegrams from Missouri. Syracuse, Mo., Dec. 7.

--Busy preparations are being made for the erection of winter quarters. Gen. Price is still south of the Osage river, and near Osceola; if he crosses the river, lively times may be expected.

Sedalia, Dec. 7.--To-day, at , six teams, while on a foraging expedition near this place, were seized by a party of Confederate teamsters and taken prisoners.

Election of a Federal Senator. Nashville, Dec. 14.

--The members of the Kentucky Legislature had a caucus on the night previous to the election of an United States Senator, at which Garrett Davis received 46 votes and J. F. Bell 45 votes. Davis was elected on the next day.

Release of Confederate prisoners. Boston, Dec. 7.

--Next week eleven officers and two hundred and forty privates of the N. Carolina regiment will be sent to Fortress Monroe, from Fort Warren, and will be released on their parole.

Appropriation for the Charleston sufferers. Augusta, Ga., Dec. 14.

--It is reported here that the Georgia Legislature has appropriated $100,000 for the relief of the sufferers by the Charleston fire.

--I have seen lately some contracts from a letter of a Leesburg correspondent of the Charleston Courier, which, I think, is calculated to make a false impression upon the public mind outside of the county, in regard to the position which the great mass of the people of Londoun occupy relative to the contest now being waged between the United States and the Southern Confederacy.

One would suppose, from reading the letter alluded to, that loyalty to the cause of Southern independence was the exception, and not the rule, among the citizens of this wealthy populous and important county. In the estamation of the writer thereof "it is a foul fester upon" the body of the Confederacy, and its loyal citizens are confined to some ten or twelve gentlemen, whose names he gives that they may be held up to admiration as being pure and true, where everybody else is false and corrupt.

I knew the gentlemen named — the most of them intimately — and I believe them to be earnest and honest-hearted patriots, ready to sacrifice "their lives, their fortunes, and their sacred honor," in the cause of Southern independence; but that they are more patriotic or more ready to do all and dare all for their country than a vast majority of the people of the country. I utterly deny; and so, no doubt, would each and every one of them. A simple statement of facts will establish the tenth of this proposition beyond the possibility of dispute or contradiction.

Loudoun county, though she gave a very large majority for the Union candidates for the State Convention, sustained the ordinance passed by that Convention, by 902 majority, in a voting population of some 2,200 or 2,300.--Her people perfectly understood their exposed position upon the Northern frontier; but, nevertheless, freely accepted the fixed alternative of war, rather than to submit to the encroachments of Northern despotism, Let join fact not be forget es Providence has rewarded her noble devotion, by giving her a battle-field which the daring of Southern chivalry has rendered glorious forever.

And, again, not with standing the fact that she has among her people a very large number of Quakers, who are non-combatants from religious principle, she has given to the Southern army from twelve to fourteen hundred of as gallant fighting men, as there are in it — men who rushed to arms as soon as the time-honored flag of their old mother was given to the breeze.

In the "bloody eighth"--a regiment which a eminent Georgia General has pronounced the most distinguished in the service — there are six companies of Londoners, and one of them, (Capt. Heaton's Hillsboro Border-Guards) was reunited right from a portion of the country, which the Courier's Leesburg correspondent would consider the foulest part of "the foul fester." These brave men won undying honor for themselves, and illustrated the invincible prowess of Southern resistance to tyranny in the blackest and hottest parts of the battle of Manassas and Leesburg, while, no doubt the Courier's valiant correspondent heard them from afar, in the safe retreat of a hospital or baggage waggon.

In addition to these, Loudoun has three full cavalry companies in the service--Capts. Dulany, Carter, and Mead. Capt. Carter's, was the company which made the gallant charge at Manassas. In part, I believe that it was the only cavalry company which charged at all that day, until after the battle was won.

Londoun has also a company of artillery, (Capt. Rogers) which did good work on the 21st of July, and a company of infantry, (the Loudoun Guards) in the 17th Va. regiment, was foremost in the fight at Bull Run on the 18th of July.

I know, that in a certain section of Londoun, known as the Dutch settlement, traitors are scattered as thick as tories were in South Carolina, in the Revolution; but as South Carolina was not denounced at that time, because of her tories, neither should Loudoun be thus denounced now because of the villainous treachery of comparatively a very small number of her people. The great body of her citizens are as loyal to the South as the citizens of any other portion of the Confederacy. She has bereaved eighteen or twenty of her sons, who received their death by the bullets of the enemy! and numbers of others who contracted their diseases in the service. She has furnished more supplies to the army than any other county in the Confederacy — Her horses, wagons, and laborers have been taken, until there is scarce enough left to carry on the ordinary work of farming, and many of her citizens living along the river, have had nearly all their movable property taken and destroyed by the Yankees, and yet there have been no murmurs or complaints. Having done and suffered all this, I think it — to say the least — ungenerous to attempt to brand with the toul stigma of disloyalty, especially upon the part of one, who, in all pro iy, has enjoyed for months the kindness and hospitality of her people.

--$15 Reward.--Ranaway from the subscriber, on the 15th day of October last, his Negro Man Henderson, Said negro is about 25 years old, very likely, not very dark, and about 6 feet high. The tips of the fore and middle fingers on the left hand have been cut off, and some of his toes have been frostbitten. He has a wife at the farm of Mr. Wm. Boulware, adjoining mine. He may be lurking near some of the camps, with a view to engage himself as a servant. It is not remembered what colored clothes he had on when he left. The above reward will be paid if he is lodged in jail so that I get him, or upon his delivery to me at my residence, in Henrico county, near Dutch Gap.

I will give the above reward for his confinement in jail, so I get him.
